  3. Hi, Tweedtech. Sounds like you've done your homework and are heading in the right direction. I think one Summary and one Small Claims is the way to go. They are almost identical, with small claims the court take your £39 then do the rest for you. With Summary Cause you pay your £39 then the court will send your papers back and you have to get a Sheriff's Officer to serve your claim. This cost me £15.97.   13. Hi, My first claim against BOS was Small Claims, which I won. My second is Summary Cause, due in court early March. The sheriff clerk in Edinburgh told me i'd have to be the most unluckiest person on the planet if I ended up in court. Said I could loose somewhere in the high hundreds but thought this was very very unlikley. You are right about the almost no risk with Small Claims, I think all you would loose was your £39.00 court fee. Its really up to you, how quick do you need the cash ? They paid me in full for my first claim,(then shut my account) I'm now on my second claim, this time using Summary Cause. Due in court in March, I'll let you know how I get on.   20. Hi, Your doing the right thing setting up another account, I was with the Bank Of Scotland for about 27 years untill I won my first claim. They then gave me 30 days to close my account and asked me to cut up my Visa card (nice people!). I have about £1,800 on the card but they said I should carry on making payments as normal and didn't ask me to pay the lot back at once. I'm not sure about your loan with Natwest, someone in the Natwest Forum should be able to help you on that one. I know it seems daunting but if I can take my bank to court and win, then anybody can.   23. Hi, Killbi11, You should go down the Summary Cause route. Its the same as Small Claims but you can claim up to £1,500. When you hand in your forms and pay your £39 court fee, the court will send your papers back and you must employ a Sheriff's Officer to serve your claim, this cost me £15.97 which you can claim back. The court will send you a list of local Sheriff Officers. You will get all your cash twice as fast. Hope this helps. Regards. Scott.

The persuer claims from the defender the sum of £xxxxx 2. £xxx Interest from xx/xx/19xx to xx/xx/20xx 3. plus the expenses of bringing the action. Section 7. takes a bit of time for me to type out.
