  11. Hi, On my spreadsheet I put 'charges as notified' down the whole colum. You will know by the amounts, what charge is what(I think) The charges I had were Returned d/d charges and excess overdrawn charge. Hope this helps. Scott.
  12. Simeon, The BOS sent me a full settlement on the day of my return date. They then phoned me on the return date to make sure I had received it. Think they were worried they might have to go to court! Best wishes with your claim. You will get your cash. Scott.
  13. Riggy, My return date was 3rd October 2006 and hearing date the 10th October 2006. As I said before I got their full settlement offer(through the post) on the 3rd and they phoned me the same day, just to make sure. At first all they put into my account was the £720 I had claimed, I had not calculated my interest before I made my claim so I wrote to them asking for my interest and court fee and it was in my account the next day. I was in Edinburgh Sheriff Court today(13th November) and the guy said my next claim would have a return date of the 23rd January 2007, longer than I had to wait before but I think its for christmas holidays ect. I made a few mistakes on my new claim, (summary cause) so the guy sorted me out, but I shall have to re type some things. Then I think I'll just post them to the court with a cheque for the fee's. Best wishes Scott.(that's me)
  14. Yes, I'm sure it is. Thats the one I used and I have a business account with BOS. The letter before action is different, It can be found in the Bank Templates Library--------Sample Letter To your Bank----Business version. Hope this helps. Scott.
  15. Riggy, Bos waited until my return date before one of their lawyers phoned me to make sure I had received their full settlement offer(that day).I think they were worried they might have to go to court.I forgot to add the interest in my claim, but phoned them after they had settled and they put the interest into my account, very helpful. Best wishes, keep us posted. Scott. ps Hope they get in touch with you soon.
  16. Hi, Terry, Yes your right about only going back the 5 years. I take it your in Scotland. You can claim between £750(Small claims) and £1,500.(Summary cause)I think with small claims if you were to loose your claim, all it can cost you is £39 court Fee ,not positive but I've heard you could loose about £750 if you go down the Summary Cause route. I've already had a claim for £720 settled in full by BOS and I'm going down to Edinburgh Sheriff Court tomorrow to claim £1,500 using Summary Cause. The claim forms you fill in are identical, but I'm not sure how much the summary cause claim costs to lodge,(will find out tomorrow). As you will be aware the banks do not want to go to court so you will get your cash. Go to Forums---Guidance notes---Scottish procedure Best wishes, Keep us posted with your claim. Scott.
  17. That's a bog standard reply. Take them all the road, you will get your cash!

  22. Hi, I'm sure it's only 5 years, something to do with Scottish Law I guess. Best wishes. Scott.
  23. Make more than one claim, you can claim up to £1,500.00 in Scotland using Summary Cause. But only make your second claim after you have won your first. Don't waste money on a Lawyer when you can do it yourself for nowt. Best wishes. Scott.
