Non disclosure imprisonment threat against RBS Data Controller!

 

Consumer Action Group User -- Zooman was today granted an order in the Barrow on Furness County Court in respect of the failure by the Royal Bank of Scotland to comply with his disclosure request under the Data Protection Act.

 

District judge Forester, making the order commented that had the claimant been able to supply him with the name of the data controller at the Royal Bank of Scotland that he would have added a threat of imprisonment for non-compliance.

 

The Royal Bank of Scotland now has until January 2007 to comply with Zooman's subject access request. The District Judge has indicated that is the Bank has not complied with the order by that time that he may make an order for imprisonment of the RBS Data controller.

I have had this prob with Barclaycard. SAR sent Sept 3rd 2006, complaint to ICO 14th Nov 2006, they wrote to Barclaycard who now expect me to wait until mid Jan 2007. Well LBA sent 2nd Jan 2007 giving them 7 days. We'll see what they can come up with.

 

If not then claim will be filed.
