Thanks everyone! Yes - pretty fast result, wasn't it. I reckon they must be getting bogged down in paperwork.

I'm going to be sending my LBA to Cap One on Wednesday...fingers crossed.

Did they refund the money to your Cap one credit card or to your bank account?

Hi there, and thanks! Well, they have said it will be refunded to my card (although I have yet to see the actual PROOF!)

I sent cap one a court a lba last week and they have offered me approx 140 off total charges of approx 300, whta shall i do?

Hi

 

I'm from Scotland !

 

I have just received a letter back from Capital One - they have agreed to refund me part of my claim to the "now" £12 charge. Am I still entitled to claim the rest back? I still don't agree with the £12 charge. My credit limit was reduced on this account and I could easily pay it all back in a short time and I want to close the account anyway so I will argue it back by sending them the second letter (before action). Has anyone else only received part back?

This is the latest ploy. £12 is NOT the 'now charge'!! The OFT have NEVER recommended this is an acceptable sum. They have only said that this is the sum at which they will get involved! Do NOT let the banks pull the wool over your eyes! Write them a letter thanking them for the offer, which you will accept in part payment, but will be persuing them in court for the rest!

Hey Give_me_it_back - really sorry you didn't get much response earlier on in the thread, but big congratulations on the result :)

 

I'll be taking aim at Capital One myself shortly, results like this always help the confidence of others. I'm using loitering in the Lloyds forum, but will have to start keeping an ear out here too :)

Thanks reload! I have found it so helpful to read others threads too. When you see a result, it just keeps you going. Oh - and - by the way - as good as Mr Udy's word - the money has been paid to my card account!
