Hi everyone

I would just like to offer any help in this forum I can. I am not an expert in Employment law, but I have run a recruitment agency for the past 11 years and am willing to help in anyway I can.

I have been given so much help and advice on CAG and would like to put something back if I can.

THats great to have someone with experience to help on this board. Are you familiar with employment law etc., Would you be able to have a look at my thread re company holding back training costs etc. and let me know what you think.

This isn't a big deal, just a wee bother cos I don't like working for free. I have cut and pasted an excerpt of a letter I sent to a former employer here:

Re: unpaid work (approximately 6 hours at £7.33 per hour, 19 December 2008).

 

 

Mr X

 

You may recall that I was employed as a temporary porter during the Christmas/sale period; and that, when I told you about the aforesaid anomaly, you promised me that you would rectify the error. Indeed, I reminded you several times about it.

 

In spite of innumerable attempts to contact you about this, and, by dint of those attempts, much expense incurred, you have not yet deigned to reply to my messages or my entreaties. Am I therefore to conclude that you care not to keep your promise? If that is so, in order to exact what I am owed, or its equivalent, you will leave me with a form of redress that I would prefer not to undertake, namely, direct action.

 

If you do not complete the requisite 'Payroll Supplement Receipt' so that I can be paid what's due to me, that is, if you reckon that these words will ultimately be at variance with actuality, you will find yourself gravely mistaken.

 

I am obviously unhappy with your blithe attitude towards what is rightfully mine (which I had envisaged pretty much from the moment I brought the matter to your attention). I hope that you can empathise: how would you react if money was owed to you – the amount is irrelevant – and despite many polite requests it eluded you because of another's incompetence or arrogance or whatever? Moreover, I now wish to be paid via cheque or into a different bank account. No more prevarications please; do the right thing!

 

 

That was a daft thing to do, no? I was exasperated, as you can maybe tell. In fact I might have made a few minor amendments before I sent it (so as to make it more conciliatory). I suppose I should let it drop... then again, it's not the first time that such a thing has happened - and I doubt it'll be the last. Any advice for me and our comrades for when these mishaps occur?

What does the law say about reducing your contracted pay but not your hours?

 

This is my O/H's problem.

He has taken advice at the CAB and wrote a Step 1 grievence letter at the end of 29/01/09. Reminder was sent 09/03/09. letter said that he did not agree to a pay reduction without reducing his hours.

No reply from Boss or manager.

19/03/09 letter from Boss accusing O/H of loosing money for the company and accussations about his work and the state of the kitchen he works in. Letter written on O/H's days off so Boss was poking around looking for an excuse. No mention of a reduction in pay again just accussation about loss of money within the company blaming O/H again! Very bad letter from O/H.

Invitation to meeting on 25/03/09 O/H's days off again but wiil attend. Nobody he can take. Can I go? Nothing to do with O/H's work and understand that I will not be able to directly say anything but can advise O/H and offer support. Or I think he will loose his cool and say something he may regret. At the end of the day O/H must come out of this with dignity intact as he has done nothing wrong.
