      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

aaahhh paid welscum the monthly payment via debit card this morning usually no problem...taken it twice with no warning and no approval from me, rang them they say their systems crashed so it was a computer glitch....has this happened to anyone else, the bank cant refund as its down to welscum to refund back as debit card payments cant be stopped

 

This happened to me in April... I'd transferred extra into my current account to cover other bills and Welcome took it!! He actually swore blind at first that they'd only taken one payment. I got the same answer from my bank. Welcome promised me a refund by cheque, which never arrived. I haven't actually paid them anything since as I lost my job and can't afford it any more :(

confused - if it was a visa debit then visa debit can charge back. If not give them 14 days to refund back to your card (thats the method they took so they can refund back to that) or commence small calims court proceedings. Especially as they record all calls and have told you already it was taken in error - you can get the copy of the phone call to prove in court if need be.

Hey BO2, not that I wish to disillusion you, but my partner last paid them on her secured loan in May 2008 (apart from a "re-write payment" in December). And they haven't even threatened court action yet! It's a long story and I will get round to posting a thread about it sometime soon.

 

I'm just playing catch-up reading on this thread, but she too got the "generous" settlement offer - 80% of the outstanding balance!

Confused,

I would letyour bank away lightly with this. After you paid in good faith. Indeed you have now lost access to your own money for at least a few days. I would also issue a complaint to Welcome themselves. And I certainly wouldn't be paying them next month if you haven't received the money back by then.

im waiting until tuesday to see if refund gone through if not then im not paying scummy welcome until the following month because i feel they have had the payment by not refunding me

Im sorry but it seems everyone who complains here are people who have missed payments on the loans they agreed.

 

Im sat here with my Finance Agreement and it tells me how much im borrowing, my monthly payment, how many monthly payments and my APR.

 

I know I can afford my monthly payment and will have little problems securing this money each month to do so, so whats the problem?

 

I am paying 60 odd % APR but thats my own fault for getting myself into bother a few years ago - im working out of that.

 

When I called they did push the PPI quite forcefully but I told them I couldnt afford it and not taking it reduced my monthly installments by almost half.........

 

But I managed to get an offer / quote without it.

 

Hmm...

 

I think I can make up my own mind without having the opinion of the careless and the misfortunate forced down my throat.

i am sat here with my finance document its great till you cant pay come back then and lets see if you are of the same opinion

P.S Making sure you can afford the repayments of a loan is just a sensible thing to do before you borrow, dont you think?

 

Rather than being a smug comfort

are you so ignorant that you think pepole dont do that we cant all be as lucky as you pall some things do go wrong in life try missing a payment and then come back and tell us you havnt a problem

oh my god ...requested all documents that are still valid from dirct group turns out that when i did my re-write i thought i had no mechanical cover or gap and it would be refunded as per the cretin who did the paperwork

now i find out after paying out for major work to the car that i am covered on mechanical and gap that it cant be cancelled on a re rite although the ppi was in part not full

And Was The Gap ,ppi Etc Included In The Agreement To Modify The First

it was an agreement to modify the 1st agreement but i distinctly remember the man saying i couldnt have any insurances as ir=t was a re-wrire which i was uncomfortable about re the gap as i knew the car isnt worth what the loan is for

i have a 53 plate vectra 2.2sri valued maybe 2.5k and my outstanding balance is 10.8k bearing in mind the gap covers me for a max of 7k stil leaves a balance if i do write the car off in an accident

sorry yes had all the insurances on 1st agreement apparently has a partial rebate of ppi but not of other insurances

does it make any difference that i only had a partial refund plus had a look on the copy of modified agreement and it doesnt state anywhere that i had any refund i only know by what direct group told me

I had to laugh the other day.

 

A woman from WF came to the house as OH had been on the sick for a couple of weeks and missed hp payments for the car.

 

She left him a letter but when he opened it the printer ink must have been running out since half the letter was just blurry.

 

They must be in so much shinola that they can't even afford ink for the office printer lol

 

Can I confirm the bit about welcome elite brokers please?

 

If they handled the insurances then is it just the insurance part that is void or is it the whole loan agreement?

 

The word agreement has been mentioned but I wasn't sure what it meant.

IF THEY HAVE TAKEN COMMISSION ON SELLING THE INSURANCE, WHICH THEY HAVE AS I HAVE 100 % PROOF

 

IT INVALIDATES THE WHOLE AGREEMENT AND ANY ADVANCE OR CAR WOULD BE CLASSED AS A GIFT

No I haven't done a SAR yet. I plan to sit down tomorrow and write letters to them.

 

I've got a loan with them as well you see.

 

If I ask them outright if they made any money as a broker for the insurances do they have to tell me?

OK lol I'll keep mi gob shut about that one and see what turns up.

 

I also remember that when we got the car they had the get £250 for your old car, but when it came to it because of their accounting processes (that's what he said anyway) they would knock off £250 but write it down as £1 on the actual credit agreement.

 

WTF was that about?

 

It was too beyond my comprehension.

 

If that's how they do their accounting then I'm not at all surprised they're in the mess they're in.
