TM legal? why didn't ovo do this themselves as they do but chose to sell the debt on for 10p=£1? funny debt you state you reived a letter of claim, why did you not reply too it.? also is there is no indication of the date this bill comes from on the claimform? how do you know its from 2022? what other previous paperwork have you received? please scan page 1 of the claimform and bothsides of ALL previous letters upto one mass pdf read upload carefully. .................. pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID.     • I've just remembered that a friend of mine had bookings cancelled on Booking.com about a month ago - and the good news is that all worked out in the wash. I'm at work now but will scribble properly in a couple of hours with the full tale.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been planning to dispute a long standing debt with Capital One for some time, and I'm glad I've come across this extremely useful site.

I'm interested in any thoughts the forum might have on my particular circumstances however, as I'm unable to ascertain from the posts I've had time to wade through whether they will complicate the matter of pursuing reclamation of my charges.

I've held an account with C1 since 2002 and kept relatively on top of it until September 2003, in that I only incurred £56 worth of charges up to that point.

After this I found myself in the classic charges spiral after unwisely doing the disappearing act from an old address.

My account (and its charges) were suspended and I was handed over to a debt collection company who's name escapes me at this point, and found myself setting up the usual payment plan of X (small) amount per month. I happily serviced this for a couple of months, then discovered that the charges on my account had been reactivated without notice, and I was racking up further debt despite the payments being made.

Having been told this was "standard procedure" over the phone at the time, and had an offer of payment refused I simply gave up attempting to service the debt.

Sure enough from there on, a statement would pop through my door once a month from Cap 1 with an extra £40 + interest tacked on to the balance, though I was never handed to a debt collection company again.

Another disappearing act on my part and a year and a half later, and I find myself in the hands of another tracing/debt collection company regarding this account, and I calculate that the balance outstanding now construes between £700 and £800 in charges.

I have a few holes in the paperwork which I plan to fill asap, and I'm interested to know if my own frankly stupid behaviour regarding this account will have effected my ability to reclaim these utterly brutal charges. Alongside the multiple defaults and stints with debt collection agencies etc.

I have a number of claims I plan to make in the near future, but the dirty tricks employed by this particular company which have served to place me in an utterly impossible situation make it my priority.

 

Anything you know that might help would be appreciated.

Well if you have a DC chasing you for a balance that is predominantly made up of charges you can get that cancelled out effectively. They will definitely have defaulted you and that might affect your chances of getting credit, so it's worth fighting it on that score alone.

 

It is your right to argue a disputed debt under the OFT debt collection guidance, so if you contact them and they start hassling you, just put it in writing to them (PM me if you want help with a letter nearer the time) that you are aware of the OFT regs and it is considered unfair for them to chase a debt that is in dispute.

hi, new to this but i too want to put a claim into cap one, is there a different letter to send to credit card companies or is it the same as the one for banks? and not sure where to find a template for this letter, any help appreciated:???:

I was also wondering if anybody is presently dealing with the debt collection firm Bryan Carter and Co?

They have a straight forward bugger off letter in the post from me today, citing my forthcoming dispute of this debt.

I wonder if anyone has had dealings in the past?
