I wouldn't. One assumes they can actually read, so will have notice the big heading stating application form. If they want to present it as a copy of the credit agreement then that's fine as it in no way complies with the Act and is completely unenforceable. Also if they wish to present this as a copy of the credit agreement then this is the document that they would have to rely on in the unlikely event that they attempted to take court action against you. Application forms can be considered credit agreements but must contain all the prescribed terms (hardly any do) and must be legible.

Hi,

 

I've been reading this thread with interest!

 

I received a requested CCA which has an A4 sheet, (pages 1&2) which have approx 30% of each side printed on. The print is blurred, but it does show my signature. Unfortunately it doesn't show anything else very clearly. Some text is missing from the top of the second page. In general, it's a very poor copy.

 

I received this from MBNA who also enclosed 3-4 VERY clearly printed terms & conditions etc, however, I do not believe they formed part of the original agreement.

 

Should I query this?
