I had the same letter. We will just have to wait and see what the long-armed postman brings then. I have this good feeling we will see data required. About to post letter to a different bank 'cos they have sent me data already provided. Why can't they read properly? When I am happy with the composition I will pass it on to you if you want.

Dear Ms Tudor,

ACCOUNT NUMBER: xxxxxxxx

I refer to my recent letter requesting full S.A.R - (Subject Access Request) on my file dated xxxxxxxxx. I had informed your organisation that I already had data from December 2000 onwards and required ALL data from my banking history with you. To date I have only received duplicated statements from 2001-2002 which is most unsatisfactory. However, I have evidence to the contrary that you can retrieve my data to approximately 1992.

For your information FULL SUBJECT ACCESS REQUEST under the Data Protection Act (1999 covers ALL data in a relevant filing system for an indeterminable period, not just statute of Limitations Act covering the past 6 years.

I refer to notes I was given from a friend of mine within the RBS group – Notes on NatWest Group PLC Archive. These will advise you how to access all of my file information going back to 1992 which is what I require under full S.A.R - (Subject Access Request) law.

INSTRUCTIONS:

Bank Office Master Index, 04, 26, then 45 (you can just do 04, 45). That is the Nat West Archive.

Option 1 gives you 12 options of which one is customer notes/events. You click that option which leads to a screen that says ALL EVENTS and press ENTER. You then have notes on account starting on (whenever you opened the account – but you can only go back to 1992). In case you are unaware you can print the page or go into the note and press Print.

If you follow the instructions above that will give you the S.A.R - (Subject Access Request) information you need to access my entire files, which I require full copies of under my data protection act S.A.R - (Subject Access Request) request.

I trust the information above will help you obtain the information I am requesting and I look forward to receiving the information in the very near future. I would also be obliged if you could send me confirmation that you will be sending this to me as soon as possible.

Yours sincerely

Off to buy some paper and then posting this today to Ms J Tudor at Bishopsgate address. I have to thank 'Hedgey' for this information as only the 1st paragraph is truly my own work. Can it be described as a sarcastic letter do you think?

Don't send to Bishopsgate address. With my NEW super-duper filing system I have found a letter from Joyce Tudor with the following address:-

Retail Regulatory Risk

2nd Floor

The Cornerstone

60 South Gyle Crescent

South Gyle Park

Edinburgh

EH1 9WF

Sorry about that.

How about amending the http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6986-data-protection-act-non.html puTting in how you understand an error ocurred in the past (employees are human after all) but you feel it is fair if you allow 14 days before proceeding to the courts. Last time I wrote to Halifax I gave them 28 days. They have responded saying they will comply within 40 - but at least I got a response and their attention. You have my sympathy however. HOW FRUSTRATING!!!!!!!!!!

Definately time you took action - I commend your patience. I threatened them in October and they are about to send me my data but it seems they are taking the **** with you. We must have them overworked.

Having failed to do this myself I would be unsure what damages (is that the right word) to claim but IMHO your £10 data fee and I think you can ask for £9 something for each letter you have written (which would seem reasonable) as I think you have to show the efforts you have made to obtain data. If anyone else can confirm if my advice is right or not I would feel easier.
