JUST GOT THIS LETTER THIS MORNING WHAT NOW ,

 

Dear Miss Lisam696969 ,

thank you for you rrecent enquiry regarding your credit file and inforamtion on it . the entry recorded is an indicator of how you conducted your account . The account is recorded as defaulted as payments were not received in accordance with our terms and conditions of trading . The absence of a signed agreement does not mean that the debt does not exist , merely that it cannot be enforced .

the recording of customer payment information with a Credit Reference Agency is not related to the legal requirement to serve a statutory default notice on a customer under the CCA i.e a payment default recorded on their file does not link to a statutory default notice .

Please note that this company is a member of credit account information services (CAIS) which is a database administered by Experian ltd to which lenders , including ourselves contribute information whether the account has been conducted within accepted terms or not . We also advise all of our customers within the info pages of our catalogue etc that we register info about them with the CRA'S . this rubric foprms part of our terms and by trading with us you have deemed to agree those terms .

We can confirm that the file has already been updated to record that you satisfied the account and that no further information regarding this account has been exchanged with the CRA'S since this satisfaction was added to the default , but the information exchanged does remain registered for six years.

 

 

they are saying they have no agreement but they are going to carry on exactly as they want so what now any help appreciated.
