I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello has anyone got t+cs for skycard/barclays from 2005.asked bank for them havnt recieved them need to send cort bundkes by next week?:rolleyes:
Write to the bank's solicitors, tell them the bank has not complied wit your request and that you are requesting them under CPR Pre-Action Protocol 4.6©. Copy the letter to the court. That should do it

can anyone advise just been told by a good friend that abbey national have offerd him 30% of money asked from bank even though he sent off a letter to refuse it and said that he wants to take them to court abbey national refunded only £170 and took another £170 stateing it was for pending bank charges since he wrote off 10 weeks ago, that he feels do not exist, he is a student and needs every penny he has phoned up those people in the paper that say they can claim the charges for him for help, can he take them to court? can he do this by himself without help? his charges were for £870

OK, calm down & take a deep breath!

 

First of all, sit down with your friend (2 heads are usually better than 1) and start at the top of this site. If your friend is smart enough to get on a degree course, this suggests he is more than capable of reclaiming his charges without some slimy carpetbagging bandwagon jumping company. There is a lot for your friend to learn from the site to effectively reclaim his charges, & I know students have better things to do (I was at uni for 5 yrs) but isn't it worth a bit of graft for £870 that he probably though he'd never see again.

 

Like I say, there's plenty of help here, but your friend needs to put the legwork in to benefit from it.:-)

 

You/he should also start your own thread on the abbey section of the forum8)

What do we need to highlight in the T&C's to bring to the attention of the judge?

 

Things like you must keep your account in credit blah blah blah or else we will charge you silly money.

 

Wording and terms that are showing that they have recently changed the wording to show that they are cloaking or vieling the charges in an attempt to make out they are providing you with a service which you don't want and is not useful.

 

Terms that show liquidated damages etc.

For example in "LTSB A Guide to our Banking Charges" leaflet of 2001 it says clearly:

 

"If you decide you need an overdraft or think you might go overdrawn, please contact your branch. It's cheaper for you to arrange an overdraft in advance, rather that going overdrawn without agreeing it with us first. Setting up an overdraft costs you nothing. If you go overdrawn without agreement or go above an agreed limit, we charge you a higher rate of interest for this unauthorised borrowing."

Hi I don't know if anyone can help but would like to proceed to court stage but I am reluctant without T&C. I have a business account with LLoyds Oct 2000. I have heard that those that have failed with their claims have done so because they have no T&C. I have asked my bank but funnily enough there was no-one in the business sector there the day I went in however will try again.

You need them for the year you opened the account and for any year when (if) you changed the sort of account you have (eg if you signed up for a premium acount like NatWest's Advantage Gold)
