    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real. Get a screenshot
    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I originally sent mine to the Glasgow address but got absolutely nowhere - they still haven't cashed my cheque so got the info and statements in the end from Boreham, which is where I've sent my second letter to as well.

I have an advantage gold account.

I Got all my statements back since 2003 from Natwest, what next? do I just add up all charges inc Interest and send total to natwest asking them to refund that amount, sorry if I sound a bit dumb but I havent done this before.

Not too sure with timescales for Natwest anything like Barclays they will send it right at the last mo.

Hi starz, welcome on board the nat west forum!

 

There's no real way to say how long claims take with nat west - some are paid in full at prelim or lba stage, whilst others end up in court. Doesn't seem to matter whether it's a large or small amount either - their responses are quite random!

 

What you will find on the forum though is lots of help, support and encouragement at every step of your claim. So whenever you need help, just post on this thread and somebody will get back to you.

Best of luck, just follow the timescales set out on here, i.e. prelim 14 days, then LBA 14 days, the file at court if no response. But dont be surprised if you dont get a response at all. Thats the norm, honestly. Onward and upward my friend. You will get plenty of help and support on here whenever you need it. Fendy xxx

I sent my request for charges and natwest received it on 18th May I had the stuart higley letter on 4th june saying they are considering etc will take 6-7 weeks, please help what do I do now?

i posted all my stuff to bank on 18th too and also recieved a letter quoting 6-7 weeks to day,

dont know how much you claiming or over what period but will be intresting to see how they respond to us both

You give them the 14 days and then send your LBA. If no response to that, you take them to court 14 days later. The 6-7 weeks is not your concern.

Can anyone direct me to a good letter template for the bank to refund my last £30 (benefits) just enough for my groceries to last until next week.

They Natwest took my last £30 and taken me overdrawn now.

I have already put a LBA letter to them refunding my charges and they are still charging me, Help appreciated!!

HELP

even tho I sent a

RIGHT OF APPROPRIATION letter to natwest last week they have taken another £38 as charges so I am way overdrawn now and now I cannot pay my phone bill as a result I am on limited service with BT.

I am setting up a basic account with HSBC so I can get my benefit paid in there.

I am claiming my charges back from Natwest I have sent LBA and their time is up now.

Can anyone advise about reclaiming the benefit they took off me please??
