Thought i would add to this bryan carter ccj me on the 21st of feb to which i payed a cheque of £10,i have now paid 2 more payments to them one cheque by the 22nd march and a postal order crossed account payee on the 22nd of april the next payment is due 22nd this month what do i do?:?

I wonder what any judge would say to them charging £20 court fees when no court action has been taken! Am certain that a judge would be looking at them and thinking hmmmmmmm only thing missing is the stripey jumper and mask.

I have reported it to the police, have a crime ref number. Will also report it to SOS as you suggest.

I certainly wouldn't have sent Calvi's letter. Look at this:

...in other words, they haven't started Court action, and haven't added the charges shown to the amount owing.

Dear Sir/madam (it's god to you)

outstanding balance £0.00 (not really but that's what he's getting)

 

You have failed to repay this debt,which is seriously overdue(so is your letterheads in being changed t _ _ser)

 

Court proceedings will be issued on 27th march 2007 (i dont think so you aint no longer trading)without futher notice to you (nothing new there then) if payment is not received at our office before the above mentioned date.(ah so you do mention some things,and would that be the office you seased trading at on the 28th february ??)

 

Court costs and interest will be added to your debt(not as much interest as is going to be shown in you) if it is neccessary to go to court and therefore the outstanding debt will increase(ah i understand just like the hole you are digging ,thats increasing all the time)

 

You must make payment before the 27th march 2007 if you wish to avoid this matter going to court(and you should stop your naughty ways if you want to prevent big dave widening your a _ _e hole from the size of a twenty pence piece to a fifty pence piece in his nice little room with a metal door)

 

Payments can be accepted by debit cards (or in your case deceit cards) and in some instances credit card. please call us on telephone number 0870 112 5132(of course i will call you what would you like to be called , thief,to_ _er etc etc)

 

A judgement order may prevent you from gaining credit in the future(yes and big dave may prevent you from going to the toilet properly ever again) and will remain on the register of judgement debt for a period of 6 years.(am i bovvered)

read the whole letter bud, it says NEW BALANCE 240.47. It does not state future balance should court action take place it says new balance ie you owe us! Now i may be wrong but thats a charge in my eyes for something that has not taken place.

The Fraud Act 2006 states:

2 Fraud by false representation

(1) A person is in breach of this section if he-

(a) dishonestly makes a false representation, and

(b) intends, by making the representation-

(i) to make a gain for himself or another, or

(ii) to cause loss to another or to expose another to a risk of loss.




In this case as the company has ceased trading then this is false representation as they claim to represent abc company.

I actually laughed out loud when I read your comments to this letter. I actually have visions of Big Dave dropping the soap for BC to pick up in the shower. Hold that thought. Your post and that of others must have cheered up loads of people who have had their lives ruined by this individual. No doubt he is aware of this thread by now. I have now made formal complaint regarding breaches of 2006 Fraud Act and 1985 Companies Act. I love this site! I informed them (Police) that complaints had been made to SOS and Law Society regarding this company. The lovely WPC asked where I got all my information from, she now has web page of CAG and she will look into reclaiming her bank charges. Lovvin it lovvin it lovvin it.

Dear Sirs,

I would like to inform you that a Ltd company Bryan Carter & Co De Havilland Drive, Weybridge, Surrey, KT13 0NT, dissolved 28/02/07 are currently trading and have not ceased trading and still operate in the same capacity as before. I do not know why this is and would ask you to investigate. I have attached copies of two letters received from them after the dissolution date of this company.

I would like to know how a dissolved company can continue to trade without having to provide annual accounts to yourselves as this is surely a breach of the Companies Act 1985. This could also be a ploy by a dissolved company to avoid corporation tax, I am not saying this company are doing this but it may be worth closer scrutiny.
