    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

still go through with it and then they will have to pay that charge as well which will teach them a further lesson. Not your fault if the cheque turns up before the bailiffs go in. For what it is worth, ikea have 11 CCJ's against them and have only satisfied two of them since september 2003. So don't be holding your breath for the cheque !

Thats very interesting, I was just putting it down to incompetence, but based on that info it seems a little more sinister. How can a company the size of Ikea act in such a way?

ha ha .......we were led to believe bad design/workmanship.

 

But its not a good advert either way for keeping relations alive......though some people swear by the sofa.......

 

 

You can access the cc judgements in a number of ways but mostly they are business/accounting associated sites.

 

If its a plc then they cant hide anything at all.

 

I recently did a company search and found details (by mistake) of pop idols Simon Cowell.................also the other week got some insider info of the finances of Virgins companies.............all 40 of them !!!

 

To avoid being libellous I wont add what I have found in these and other searches.......what I would say tho is that its quite an eye opener.

martin hit the nail on the head. I have access to programmes which assist me day to day so hence the reason I can find this stuff out.

 

By the way, 11 CCJ's against a company like ikea means nothing, they are very cash rich and their assetts are obviously worth a bit so they would always borrow against those.

Very very true & even Harrods to my knowledge have had unsatisfied CCJ's in the past. but I still think it would be a good idea to start a register where these could be displayed thereby giving them a taste of what it's like to be refused business/custom. Many of these companies receive goods from suppliers who, because of the name, don't bother to check their credit worthiness only to find out later that they are in some recent cases on the brink of collapse. Also many customers have lost large deposits

I didn't say there were my friend! but I know they did in the past including one that was for no more than £400.

 

My whole point is that these same companies charge us more % on credit & take a high moral tone when we default yet here we are and what they do they do with impunity because no one bothers to check on THEM. Why mainly because the information is not available to the common punter when I think it should be. That way we might be a little more circumspect about who WE deal with. Also if the register included verifiable examples of their behaviour they might think twice before acting the way we know they do every day

His applications for a British passport have always been refused.

He complains about his misstreatment here but forgets to mention he actively encouraged his sons relation with our future queen.

In some ways what happened after that, saved him from not only keeping his business here but many other things too.

One thing is for sure..........we wont see him on here claiming penalty charges

 

He is far to busy with other things.........capitalising on days that could have been but were cut short.......for obvious reasons

Well finally they have paid up :-)

 

 

Well done............thought it was never going to end.

 

Maybe now I bet you wished you had gone to MFI ? They are known to have gone for a better image these days.......and no doubt at all would have given a refund straight away.

 

My wifes relations live on the outskirts of Moscow and IKEA started building a warehouse there 3 years ago..........each time I have been there I ask why its taking so long to finish apparantly its because the contractors keep changing after not getting paid so the job keeps stopping.

I reckon here the same building would be up in 6 months.

 

Ikea cant even pay the money to build its own bloody store !!

Sorry, wish I had seen all this sooner and could maybe of offered some help

 

 

Not to worry, we got our money back and purchased a bed from elsewhere but they have lost me as a customer for life.

 

I'm currently awaiting a reply from the manager regarding the whole debacle.
