Hello everyone,

 

Better late than never, but I did promise to post copies of the alleged agreements I received from MBNA!

 

I must point out that these "agreements" were sent as part of a SAR, and not a CCA request.

 

 

So here they are:

Please note: "Application" was declined! Therefore this cannot be an agreement!

The alleged account actually pre dates all of these applications.

 

None of these three applications actually refer to the alleged account!

 

This has got to be why an application form cannot be an agreement!

Hi Jeff

This is extremely interesting as it shows as you say quite clearly that what we are led to believe is a credit agreement can only be an application form.

 

I'm awaiting my CCA's which will or will not be here by the end of the month and we shall see what turns up as far as "agreements" are concerned.

Thanks for your comments.

 

These "agreements" were in response to a SAR. I have however now sent a CCA request to MBNA. Let's see what they send! The 12+ 1 month is up tomorrow, oh dear!

Maybe I'm in a thick mode...or maybe its the bottle of Cava I got as an Xmas pressie that I'm now drinking! But...if an application for credit/credit card was declined....how can you have an agreement? Would it be an agreement not to have credit, and not to use the credit card you applied for but didn't get?

Surely if you applied for a credit card...the application process, and were declined...there was no Consumer Credit Agreement...as no credit was approved or agreed.

Well I may be talking gobblygook, or I may have missed something (its the 2 glasses of Cava) but I wish you good luck.

That's exactly the point we are trying to make.

 

They're application forms, and nothing else. None of them apply to the alleged account in any case. They haven't even sent an application form for the alleged account! Just those three applications, which, as you are aware, were all declined!

 

Don't you just love MBNA???:grin::grin::grin:

 

What do they take us for?

Still nothing from them.

 

I have now sent them a letter informing them of their CCA default!

 

Awaiting a reply. Not holding my breath!!!:D

 

Link, who now own the "alleged" debt, have also not supplied an agreement.

They are still sending letters though. Sent letters etc to Trading Standards, who actually stated they were interested in my case!!!:eek:

 

So, lets see what transpires next!

Have you received sight of your cca from MBNA yet??

Hello everyone,

 

 

I have received absolutely nothing at all from MBNA!!!

 

No response! Nothing!

 

 

Now then. From Link I received, a while ago, a letter saying they were contacting the OC in order to obtain a copy of my agreement, but this may take some time. (No s***!)

 

They also said that the account was on hold for 14 days! (I think it is on hold until the default is remedied!)

 

After the 14 days, I received another letter asking to contact them etc. It also said that their investigation dept will search for any assets that I may have! That was about a week ago. (copy of this letter was e-mailed to my local TS!)

 

I am just about to reply to both MBNA and Link, basically telling them that they can sod off without any CCA!

I have recently received, from Link Financial, what they claim to be my CCA agreement.

 

So it now seems that I have 4 alleged agreements!!!:o

Just out of interest, would the fact that MBNA failed to provide a copy of this particular alleged agreement when I SAR'd them, have any bearing on this case?
