By reason of the Termination of the Agreement by the notice, defendant became liable to pay the sum of £7502 7. The date of maturity the agreement is 24th August 2027. 8. Further or  alternative by reasons of  the Defendant breaches of the agreement by failing to pay the said instalments, the Defendant evinced an intention no longer to be bound by the Agreement and repudiated it by the said Notice the claimant accepted that repudiation 9. By reason of such repudiation the claimant has suffered loss and damage.   Total amount payable £19570 Less sum paid or in arrears by the date of repudiation £12064 97 Balance £7505 (to include charges.) The Claimant understands that the proceedings for contempt of court may be brought against anyone who makes or causes to be made a false statement in the document for verified by statement of truth without an honest belief in its truth.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A few queries:

 

Can I still claim back charges from Capital One, even though they are now only charging me £12 per month if I go over my limit?

 

Also, should I include these £12 charges in my claim?

 

Do I use the same standard letters that are used for the banks?

 

I have my statements, so don't need to request charges information. However do I need to write concerning manual intervention? Or should I include this in the Preliminary Approach for Repayment?

 

EG: Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.

 

If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

Hi PC,

I see no one has replied to you.

Yes you can claim back your £12 too as we still have no indication that this covers their costs. You will probably get a letter saying the £12 are lawful etc but just carry on with your letters.

You can add that paragraph into your letter if you wish, I had my statements already and I didnt put it in, but you can if it puts your mind at rest. usually tho i think this is just to prove that the administration costs are all computerised, which we pretty much know they are.

You will probably have to file for court with Capital one as they dont seem to pay before then.

yep Deller beat me to it. You might just need to change the odd phrase so it is in credit card terms rather than bank terms i.e overdrawn etc to overlimit.

I'm about to send my LBA to Cap One - but I have some serious doubts about the spreadsheet I have used (taken from here... http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html I have used England - Advanced - Excel). Or put more accurately how I've used them. In a nutshell... the sheet does the following

 

(Total amount charged in fees over the period of time)

 

Divided by

 

(The statement balance Month 1)-(the payment made in respect of that eg. the one which appears on Month 2 statement)

 

Multiplied by

 

Total interest charged as per Month 1 statement

 

= interest to reclaim for Month 1

 

I might be being thick, but I don't understand why the following month's payment needs to be deducted? Can anyone explain to set my mind at rest?

Received an offer (which crossed in the post for my LBA - ha ha!) for around 1/3 of my claim - basically the difference between old fees and £12. What should I do? Reject it and restate my intention to go to court if full amount isn't repaid? If so is there a standard letter to reject it?

Yep I would reject and give them an extra 7 days for your court date being as the offer crossed with your LBA. Tell them as a gesture of goodwill you will extend your deadline to blah. You will then only receive letter saying that was out final offer and it probably wont be within your timescale anyway so just file at court on the date you give.

If you claim the compounded Contractual interest, it's what they have charged you. Can be between 25% to 35% on each charge, or higher in some cases i have seen.

 

Bottom left of the grey area on this calculator will give you your currant APR.

Just take an average of the cash advance monthly interest and the purchase interest.

Type that in to get your APR..

 

Add that amount to each charge and it will compound it for you.
