    • Hi I was caught shoplifting 4 items £20 worth, I’m petrified the Police will come to my house now please can you help. What can I do I worried about my job. 
    • I heard nothing more from J&P but have now had an email from the bank saying they have instructed IDR to act on their behalf?  so are they just passing it back? Selling it on again? I don’t know if this is a good or bad thing 
    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HSBC Prepared charges list = £2680.00 + interest £537.08 Total = £3217.08 and sent 1st request 15th jan

Rec reply on 23rd jan (looking in to it)

Contacted by phone 1st feb (told it takes 8 weeks)

Contacted by phone 22nd feb ( told i should of rec letter dated 14th feb) never arrived! (so they said they will send copy of letter urgently)

Rec letter 26th feb (dated 14th feb) offer letter of £2358.00.

Letter states no to interest. and also says "If your claim for a refund proceeded to Court, we therefore believe we would succesfully resist any legal challenge in relation to these fees."

 

I think they are trying to scare me into accepting this offer!!!

 

What does everyone think I should do?

Also for your hourly rate, how did you come to £9.50. It that based on your employment eanrings? Can I do the same?

My Compond rate is the rate they give you only need to mention that you want to claim contractual intrest rate. Ask them you can work it out but they CAN DO IT FOR YOU as they will allredy of done this just in case you ask. Do me a favour if you call me i will explain cause i hate typing. 07870 900 889.

Hello to all

 

Been a little while.

 

I need Help!!!

 

I am completing the AQ as my deadline to hand in is today i am following the guide on completion but am a little confused on section G ( Other Info)

 

I have wrote I believe the case will last no longer than 1 hour

I request the Judge to order a form of basic disclosure from the Bank.

 

Is this correct so far?

 

Then what do I Add?

 

Looking at the notes do I have to add the suggested Draft order for Directions? And Do I have To change any of the wording?

 

I am really Sorry but I dont want to get this wrong

Hey all I just ended up as follows:

I believe the case will last no longer than 1 hour.

I request the judge to order a form of basic disclosure from the bank.

I have attached a draft order for directions for consideration. I believe this will bring a speedy end to litigation.

The draft order for directions was devised by the mercantile courts for a similar case.

 

I have attached the suggested template that has been given to us in the notes, but changed the details to represent myself. I.e case number, names etc.

 

It looks like this is correct but as i have had no reply from anyone i will go ahead this afternoon and drop it in.

 

I did call the courts to check if DG had filed their AQ and i was told that they havent as yet. Today is the deadline though.

 

So I asked the lady what happens if they dont file today, and she said that the judge will be sent the relevent documents tommorow and he will make a desicion as to strick out or give DG more time.

 

Lets see what happens!

Hi All,

 

Well i called the courts this morning and they have told me that the Judge has issued an draft in saying that HSBC have until 30th may to file their AQ. If they dont the lady said i can file for judgement.

 

Bloody Hell!!! When the shoe is on the other foot, us normall ppl dont get given these extra time oppertunities.

 

So i suppose we just have to wait and see

kingmills, at least the Judge has got round to looking at yours, I'm still waiting and as of yesterday DG hadn't filed an AQ. I sent a hastner to them yesterday, will let you know if I hear anything back from them.

HI Rob, I have been on holiday for a week taking a well needed break in Gran Canaria.

 

Yes i have received a letter actually another one came the next day aswell. both from DG. The first which i am sure you will be happy to hear is a full offer including all charges. The second was posted the following day which is a copy of there AQ. I have to do a bit of reading on how to accept the offer and which template to use so i shall let you guys know what Letter i have used.

if it's a full offer with everything included (charges, interest, court fee, aq fee - if paid) then this one is fine:

i'm really glad you've got your offer - when did you file your claim?

 

don't stop the court stuff until you actually get the money - it seems to be 7-10 working days from you accepting.

 

but when you do get the money - be sure to write to the court and tell them thank you, it has been resolved.

and....

please pm a moderator with details like -username, which bank, date of claim, amount of claim, date settled. this goes into a data base and peeps who have to send in the court bundle use it as evidence - so, it helps others who haven't yet got their offer.

Get in there my son! gald to hear of your result mate! Hopefully i'll not be too far behind you. That's if the judge ever gets around to looking at my claim! I phoned today only to get a talking brick message saying that the courts have taken an extra day off for bank holiday tuesday! lazy, workshy, chiseling...... Sorry, meant to say they deserve it! Guess i'm in the wrong job, I had the plague last week and I still had to go to work!!

Hey everyone,

 

Once again thank you all for all the help. I have checked the account today and it has been transferred.

 

So now i got to pay off my arrears on mortgage. Shame really could of done with that for another holiday.

 

DG have asked me to sign and return a confirmation they sent me once I received the funds. Is this normal?

 

Anyway I believe that I now have to notify the courts in writing.

 

Is there a Template Letter which I am supposed to use. If So could someone send me one.
