    • OK but it's always best to scan up these letters you mention so We can decide proper actions/responce/use please scan them all to one mass pdf in date order.  Read upload use the online sites listed Dx
    • Instead of ridiculing them you could point out the embarrassment they will have in the papers if they persist in being in Court with a little old lady. it also won't look good for their landowners since negative comments afffect them too.
    • I'm going to say they haven't complied with the PAP although they did write saying they would be issuing a court claim in their letter they also state I had an agreement with OVO which they have a copy of the agreement and its terms and condition which I have definitely not seen. Also I've technically never had an agreement with OVO but with SSE I didn't even realise they had sold to them until this letter!
    • I have had a pre "warning" from TM Legal regarding 2 old debts stating they are going to send a claim form in email. I was sent a PAP form which i responded to on both but like a melt i sent their PAP pack back to them in my request for CCA etc using the CAG response form. I have not to my knowledge received a response for either. my question is, will sending their pack back cause me issues in the future? can I request they send this back to me?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i know how hard it it not to phone halifax but dont do it ssl told me not to and it worked for me you can phone the court though to see if its been acknowledged listern to ssl i think she knows best

Just rang court again no acknowledgement as yet :D 6 days to go till 14 days up,hoping they don't acknowledge now :p thing is i won't even know because i go away for a week on hols on monday :shock:

Well was last day for me to hear something before i go on my holiday (monday) no letters no credit to account:( i am going to take my court letter with me so i can keep a check as to wether they have acknowledged and of course use the internet room to check my account :D,so lets hope they is some news to tell you when i get back! i hope buffy has had the little one too! anyway will catch up when i get back cya soon xx31.gif

Well guys i am here enjoying the sun and guess what.....

alifax didn´t even bother acknowledging so i win by default!!! i have been checking my account everyday and nothing was in,i took my court papers on holiday and rang the court this morning and they told me they haven´t had a acknowledgement so i guess thats it i can´t file my default till i get back so it will be tuesday when i get to the court to do it,it seems a big let down after all this and i still cant mentally think i have won as such until i see all that money in the bank,does anyone know how long after you do file a default that it is before they pay up??? I am still checking my bank account online and will let you all know if they pay up,but just wanted to say thanks to everyone for all their help i couldn´t have done it without you all,ssl iwill be picking your brain again when i get home about the court papers i have to fill in....:D see you all soon julie xxxxxxxx

Hmmm it seems i was misinformed when i got back from my hols yesterday they was a letter from court saying that halifax acknowledged my claim on the 28th!! i myself thought they had to do this before the end of wednesday cos that means now they have had 15 days (or is it me???) it was deemed served ont he 14th so wouldnt that be day 1?? silly woman at court told me when i rang them last thurday on holiday that they hadnt acknowledged so i am not a happy bunny as they now have a further 14 days:mad: or is that 15 :mad::mad:?? i am well peed off now checked account nothing in either.

They can acknowledge the claim like this.

 

The court can give a days grace. It is ok though, keep an eye on your account now.
