Borrowing in April 2024 was £1.5 billion more than in April 2023 and £1.2 billion more than the £19.3 billion forecast by the Office for Budget Responsibility (OBR). Public sector receipts grew by £1.6 billion compared with April 2023, however, this growth was outstripped by a £3.1 billion increase in spending over the same period. Since our March 2024 publication, we have increased our initial estimate of borrowing in the financial year ending March 2024 by £0.8 billion to £121.4 billion, now £7.3 billion more than the £114.1 billion forecast by the OBR. Public sector net debt excluding public sector banks (debt) at the end of April 2024 was provisionally estimated at 97.9% of gross domestic product (GDP); this was 2.5 percentage points more than at the end of April 2023, and remains at levels last seen in the early 1960s. Excluding the Bank of England, debt was 89.9% of GDP, 8.0 percentage points lower than the wider debt measure.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Personally I would reject their offer and wait for them to pay out the CI, but it really depends on your own situation.

hi its callen, hadenough's girlfriend. thank you for your opinion. since getting the offer we have been offered a loan from a friend which would mean we can carry on with the claim. however i am really scared of rejecting so much money and then losing at court and getting nothing.

Hi all, is there a way to alter the simple excel 8% spreedsheet to the contractual interest? I'm not computer literate, and am having trouble with the google ones! I have read the info on how to sort them on other threads, but I just don't get it!

It would appear that was the one I tried 1st. Because it was such a large figure, I asked Vampiress to have a look, she transferred the info to her spreedsheet, and got a totally different figure! She sent me a link to her chambers, but the spreedsheet won't download, and the others I've tried from her chambers are view only, so I can't type in them!!

Was there much difference between the figures? this needs to be looked into if the same figures are bringing up different results.

 

I've heard something about having to subscribe to google before you can use vamp's s/s.

don't know what to suggest P'o, I wish I could help.

 

Maybe go with Mindzai's spreadsheet and let the bank either pay or dispute the figures by providing their own calcs?

Hi all, managed to download speedsheet, put in a test charge of £40.00, and got over £148,000 in interest! nice, but I think it may get questioned!

Shove a single example charge on a post here, and show:-

 

amount

date of charge

interest rate

 

You'll have several answers to that within a few minutes, hopefully (not from me - I'm logging off - did I hear muted applause ?)

 

If they're roughly the same, then you can check that when you get back to the spreadies.

 

It's usually something simple, like date format, or interest rate format.

 

If no joy, then PM me - I'll fix it for you for 10% !!!

P'o have you made an error with the interest rate? I thought you said Vamps had put your figures in the spreadie for you, or am I not following this right?

Hi, Bong & BK, I had a flesh thought!!! I went back a tried downloading the s/s Vampiress sent me, with success! I can now see where the difference has arisen. I'll PM Vampiress with query/info. and get back to you as soon as I hear something.
