By reason of the Termination of the Agreement by the notice, defendant became liable to pay the sum of £7502 7. The date of maturity the agreement is 24th August 2027. 8. Further or alternative by reasons of  the Defendant breaches of the agreement by failing to pay the said instalments, the Defendant evinced an intention no longer to be bound by the Agreement and repudiated it by the said Notice the claimant accepted that repudiation 9.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello. i've been reading through this site for weeks, or so it seems, and just when i think i've got it straight, i'm not sure anymore!!!!! I know I've paid loads in charges.

 

To date i have asked for 6 years worth of statements. and then totalled the sum of charges.

Am i right in thinking my next step is to submit a letter found at this link:

You've got it in one! Proceed with the prelim letter, remember to edit it to your own circumstances. You will probably get a fairly standard 'sorry you're unhappy but we're not going to do anything about it' reply. So, 14 days after sending the prelim letter, move on to the Letter before action.

im assuming i get a N1 form. i found one i can save off the HM court website. do i just fill this in and send it? do i send it to my local court?

 

any hints tips and basically poiting in the right direction would be grand :p

you can pick up an N1 at your local court or do it online through MCOL.

Hi, yep you need the N1 form from the HM website (N1 form in pdf formate with form filling) a guide to filling it in is here POC N1 Hard Copy Version you need to fill it in and send to your local county court together with the relevant fee (County Court Fees). You can use MCOL instead but its a bit awkward to fill in, the N1 form is far preferable IMO

Hi again

They have 14 days from when the claim is served (served about 5 days from today) to acknowledge it, and 28 days from when claim was served to enter a defence. You should receive a letter from the Court when these happen.

thanks Barty,

 

i have just recieved the form completed from the court, do i need to do anything with it now? or just wait the 14 days and if i hear, or not hear from the court within that period then fill in the form?

i have just recieved notice that acknowledgement of service has been filed.

 

date of service is the 5th April 2007

 

just confirming what i have to do now?

how do i put together defending paper work etc?

Hi

OK they now have 28 days from the 5th April to enter a defence. When they do, you will receive a copy of their defence and you may receive an Allocation Questionnaire to fill in (lately the Courts have been dispensing with the AQ so you'll have to wait and see). Barty beat me to it.

 

If you get the allocation questionaire it is fairly simple and straightforward and guides you through how to fill it out.

 

The important parts of the "other information" are that the Judge and court is looking at -

 

What the issue is - unfair charges to your account not disclosed

 

What has you making a claim - seeking costs for their overcharging

 

What reason or belief you have to back up your claim - bank will not justify charges - actual costs v charged costs

 

What you are seeking from the court in a decision - i.e for sums overcharged to be refunded

 

Also put in their any information that the judge could look up or find for further information or reference. i.e any cases won against the bank you are claiming against etc.

 

They do read this part of the form! It gives them a brief overview of what you seek and gives them additional information to back up what you are claiming.
