    • Instead of ridiculing them you could point out the embarrassment they will have in the papers if they persist in being in Court with a little old lady. it also won't look good for their landowners since negative comments afffect them too.
    • I'm going to say they haven't complied with the PAP although they did write saying they would be issuing a court claim in their letter they also state I had an agreement with OVO which they have a copy of the agreement and its terms and condition which I have definitely not seen. Also I've technically never had an agreement with OVO but with SSE I didn't even realise they had sold to them until this letter!
    • I have had a pre "warning" from TM Legal regarding 2 old debts stating they are going to send a claim form in email. I was sent a PAP form which i responded to on both but like a melt i sent their PAP pack back to them in my request for CCA etc using the CAG response form. I have not to my knowledge received a response for either. my question is, will sending their pack back cause me issues in the future? can I request they send this back to me?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Some courts are doing away with allocation questionaires to speed up the process.

 

If you don't receive an allocation questionaire and receive a set of basic guidelines for your case, this is acceptable and will give guidance and instructions on how to proceed.

 

It is worth keeping in touch with the court as well as we all know that Royal Mail can at times not be reliable, so make sure you don't miss something and continue to be pro active.

 

For further reading and worth noting is to read up on court bundles. Often it will not get to this but understanding how to put them together and knowing what you need, means no panick later if they are required.

Bundles are easy and straight forward. The link above and reading now will give you more confidence for what may lay ahead and with confidence you don't doubt what appears from your post, a bit of fear of the courts.

I received my aq for lloyds yesterday

 

Pain in the ass to fill out in a busy lifestyle? perhaps!

problemetic? NO

 

I have filled in 2 aq's so far out of 3 cases, and when I actually looked around a filled in IT WAS UNBELIEVABLY SIMPLE (follow the link supplied above)

 

There is a new"ish" method of filling in an aq; it may take 4 hours to read thread but may "knock off" 2 months off ur case?

i got a letter throught he post this morining. replyin to my intial enquirey made onteh 1st March. saying they apologise its now inthe hands of the legal team due to me filing a claim. so im going to ignore this letter :D but what do i do now? lol:confused:

If your 28 days are up and they havnt filed a defence then you can file judgement. But have a read first.

im just thinking if this is right...

 

i filed the claim then the defendant acknowledged the claim. 28 days have past.. since that acknowledgement. would i have been notified if a defense had been filed?

oh no :p

 

i have just rang the court to find out about the claim. apparently Lloyds filed a defense on Firday just gone and the court are sending me a copy of it.

 

the judge has put the date too the 7th of June. which wont be good as im holiday yikes!!

 

ill have to confirm that date and maybe get it moved.

 

oh dear now i wonder what wil happen now?

"Once a defense is filed, your claim will then be transfered to your local court, who will send you a copy of their defense, and an allocation questionaire. This has to be filled in and returned within 14 calendar days."

just an up-date, i just rung the court!

 

my claim is to be assessed by the judge on 27th June (thankfully after i get back from holiday)

Apparently im not required to turn up as it will be assessed along with all other bank claims of similar sort and if possible a ruling will be cast for the whole claims submitted.

 

So does this mean i dont have to do a court bundle?

And apparently i wont hear anything till after this date.

There are others more experienced than I am on here but my advice is to prepare and submit as full a bundle as possible. If you don't the judge won't be able to make a judgement due to lack of evidence even though he probably knows the gist of each case off by heart, you could end up with an adverse judgement like the recent case at Birmingham where from what I can see it was thrown out as neither side produced terms and conditions and so the judge couldn't say if a breach of contract had occured. It's probably only a technicality which will be over turned on appeal but adds to the hassle.

 

Good luck, I'm one pace behind you as my LBA has just gone off.
