  1. Hi rebel - thanks, I am aware that the door is pretty much closed. However, seeing as I'm unemployed at the moment and being chased by a DCA for an Abbey o/d made up of charges, I think it's worth trying the hardship route. What I'm trying to establish though is which address to use for an old Abbey account - I need to write to them first before FOS. Thanks
  2. Hi Can somebody please confirm for me which address I need to write to - I had an account with Abbey which has been passed to a DCA. I've decided to try and claim charges back from Abbey (Santander) after all (I figure it'll put the account back into dispute and keep DCA away from the door!) - the old address I had was: 2 TRITON SQUARE REGENTS PLACE LONDON NW1 3AN As it's now been sold to Santander will I need to write to them instead? Would it be the Bradford address? Thanks guys x
  3. Thanks for moving the thread! I'm not sure if it's worth pursuing the bank charges with the OFT - I'll need to put together a good letter explaining how I meet their new hardship guidelines. Any ideas how I can keep Link off my back? I take it because it's a bank overdraft debt that a CCA isn't appropriate....
  4. Hi ims - thank you for your reply! Yes, it was a bank account. Link called me saying that they were a courier company trying to deliver a parcel to me and wanted to check they had the right postcode. I refused to give them any information and they passed me through to another person who said they were contacting me about an Abbey account. I said I would only deal with them in writing so they've sent me a letter confirming that the debt has been assigned to them. Sneaky so and so's!!
  5. Hi Folks - wonder if anyone can help please? My claim with Abbey stalled back in 2007 and I haven't pursued it since because of the 'stays' in place on claims. I've now had a phone call out of the blue from Link Financial who say that Abbey have sold them my debt and I now owe them instead. So, my questions are: 1) Does the Abbey account still count as being in dispute? I didn't get to the point of taking them to court because I couldn't get the court fee together. 2) Is it worth re-igniting my claim with Abbey? I've been out of the loop of the back charges argument, but from what I gather it's not really progressed much? I really want to get Link off my back - the debt with Abbey is completely made up of charges and I don't want to give them anything when the charges were unfair in the first place. I've recently re-looked at the charges spreadsheet I had and they actually owe me about £700 more than they say I owe them! Any advice much appreciated

  7. Thank you both for your replies and taking the time to read my post @debtinfo: We've lived together for 10 months and pay half of everything, totalling £500 pm. Prior to me moving in, my partner lived here alone for 4 years. @trumpeter: thank you for your recommendation, I'll look them up. TBH the monthly payments aren't crippling - yet - as I say they are only small, mainly because I don't know what my job situation will be in 6 months time. However, I don't want to be having to live in fear of the postman and dealing with DCAs for the rest of my life, not to mention the worry of being able to pay come September.   8. Hi all I hope someone out there can give me a little advice, I have read through several posts and advisory leaflets but I can't find an answer to my main question... A bit of background first - I have around £40K in unsecured debts (including a mortgage and secured loan which are both now unsecured as the property was repossessed and sold) and am making very minimal payments to most of my creditors. I am on a 12 month contract at work and will be unemployed from the end of August, (I'm a teacher) I have also been off work with severe depression since the start of February which won't help when I have to start looking for a new job. Looking to the future, I can't bear the thought of having this level of debt hanging over me, only chipping away with tiny amounts - it'll take me more than my lifetime to pay it off! I feel like I need to take some action so that I can start to feel positive again. I am considering bankruptcy but I want to be sure that my partner won't be liable for anything - all of the debts were accrued before we met and they are all in my name. I am living with my partner who owns the house and I pay a monthly rent to her to cover my share of bills etc... She has a substantial sum in savings and some equity in the house - but I don't want her money, as far as I'm concerned the debt is mine and mine alone and I wouldn't dream of asking her to bail me out. We had an appointment with CAB at the end of last year but the woman we saw was very unhelpful and quite insulting - but that's another story. To be frank, it's put me off using their services again. So, if you've read this far (and thank you if you have!) my question is - if I go for bankruptcy, will the OR take any of my partner's savings etc...? I know that I could just continue to make token payments to creditors but I'm only 33 and I would like to be able to buy a new house with my partner at some point in the future. Has anyone out there had a similar situation? Any advice much appreciated!

It's been a while since I last posted on CAG and I'm so pleased to see how much the site has grown - it's encouraging that people are prepared to help each other to fight back on unfair practices I have recently received a PCN from G24 for overstaying my welcome in a retail car park in Crewe - I had absolutely no idea that there were any restrictions on how long you could park there for. Anyway, I have no intention of responding - having read Pete Jones' article (http://www.logiclaw.co.uk/pages/PJ.html) regarding contract law and PCNs it is clear that they haven't got a leg to stand on. What interested me though was a note on the back of the PCN which states: If you believe that your personal data has been used inappropriately, you may wish to raise your concerns with the DVLA (http://www.dvla.gov.uk) or the Information Commissioner (http://www.ico.gov.uk). Details of their complaints procedure can be found on their respective websites. Hmmmm..... Surely DVLA should only release personal data if required to by law - since G24 are clearly acting outside of the law, is this worth pursuing? I'm hoping that someone with a much better grasp of legalities than me may be able to advise.....
