hi

 

i've been receiving debt letters from aktiv for a debt they are saying that i owe .

i have no recollection of the debt as it must be from more than 8 years ago .

i went through a divorce around ten years ago and was in some debt .on the letters they don't say what the debt is for or for what company ,it only says the amount i owe .

they are now threatening me with court and putting a ccj on my credit account .

i am just wondering if they can do this with a debt that is so old and to be honest i dont know if it was paid off or not.

up until now i've just ignored them as they havn't said what the debt is for.

can i do anything about it or are they entitled to chase me for a debt that old?

there is nothing on my credit file as yet in regards to this but reading on here it might be early days

Hi Dazza. If you believe it has been over 6 years then the debt will, more than likely, be statute barred and you do not need to give them anything. Take a look at this link and use example letter M to send to them. Hopefully that should do it and you'll hear no more.

I agree with Pam.

 

If they go away after you send that letter, you should consider making a complaint to Trading Standards. It sounds as if the debt is statute barred and AK have no business making an empty threat of court proceedings in order to scare you.

 

AK have no excuses here. Chasing people for statute barred debt is in breach of OFT guidelines and threatening people with court proceedings is doubly so. AK have a responsibility to ensure that they only chase for valid debts and ignorance is no excuse.

 

They are extremely well known for doing this sort of thing and the more people that complain about them the greater the chance is that the authorities will act decisively against them.

This happened to me with ECI Debt - sent them the letter, but they kept hassling, so I eventually emailed the MD. taht soon stopped them!

All help is merely my opinion only - please seek legal advice if you need to as I am only qualified in SEN law.
