    • If that was the reason then that is good news. The whole reason that being able to charge £100 for breaching private car park rules is because the law Lords decided in a celebrated case that the rogues had a legitimate interest in keeping their car park spaces available for all motorists . {parking Eye v Beavis]. However when the business is closed then there is no legitimate interest in keeping spaces free so to charge £100 is a penalty. As such any Court would automatically throw out the case  when he penalty charge is accepted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

Just thought I would add a new thread for my claims of charges which Halifax has unlawfully applied to my account for the last six years. I will be sending for my 6years of charges tomorrow. Wish me luck.:rolleyes:

 

Oh, by the way, i just wanted to know one thing. I have two accounts with Halifax, one normal one which is the one I have been excessively charged on and my overdraft. But, I was wondering about my overdraft, I am about 5pounds over my overdraft of £1750, so because I havent got any funds in it, will they request full payment of my overdraft when I send them the preliminary letter?:-| :?

Firstly welcome to this superb site, I am new to the site too and I am sure that someone will answer your question regarding the overdraft very soon. Just do what I do and read as much as possible. Hi all,

I have checked to see if my letter was received by the Halifax and it hasn't been signed for, I sent it first class recorded. I thought it was next morning delivery but maybe thats for special delivery.

Hi guys just a quick update and also a bit of help needed.

I had sent my SAR off to the Halifax on Monday and received a letter today, saying the following

 

Dear Miss Osman

 

Thank you for your letter, which was received at this office on 29th January 2007.

 

I am sorry to learn that you are unhappy with charges applied to your account.

 

We're keen to deal with your concerns as quickly as possible. A customer relations manager will investigate the points you have raised and you will receive a reply shortly, but certaintly no later than 4 weeks.

blah blah blah....

 

Now, I am a bit confused really, because I sent a letter requesting my statements, I havent started complaining yet....Should I send them another letter explaining that I only requested statements and that they still are within my timescale?

Sorry, but should i send a letter back stating my request....because they have only sent me a letter saying sorry to learn about that you are unhappy with charges on your account, i havent complained as yet...should i send a letter stating my request again, please help and also could you tell me what to say in the letter, i want to post it off today

no i havent received my statements, this is the first letter from them, but it was for me as my name and account numbers are stated there!!! What should I write in the letter? Sorry to sound daft, sometimes the most simplest things can be so difficult :o

I had wrote you a letter requesting a fully comprehensive list of all the default charges for direct debits, unauthorised overdrafts and standing orders on my account which I have paid for over the past six years dated 29th January 2007, which you had confirmed it had been received on 29th January 2007. I had also enclosed a maximum statutory fee of £10 cheque.

 

However, in your letter dated 31st January 2007, you did not mention the statements/lists that I had requested. Please note that the 40 days in which you have to comply with my request is active.

 

I look forward to receiving my details within 40days.

Hi all, just a quick update. The letter which I wrote above was sent yesterday via recorded delivery, so lets see how long the statements will take to arrive. My only concern is though, they havent cashed my cheque as yet so....its gonna take a while right???

sorry but am really confused. I sent my SAR letter off on 29th january, but I did also email them the same day to their customer relations department. The letter I sent off was recorded, but when I do track and trace there it hasnt been signed for....but i did receive a letter yesterday from halifax saying that they are sorry that i am unhappy with the charges and has been passed on to the customer relations manager. So i decided to send them a letter yesterday explaining that they did not mention anything about my request for SAR and that letter was recorded as well but no signature on that one either. What shuld I do? Should I give them a call.

 

I would really really appreciate help please....

Anna, I would call them and ask them for your statements, I had a similar letter like yours and called them and actioned a £5 fee from my account and got my statements in 2-3 weeks after, remember, they have up to 40 days to comply with your request.

Just say because you are looking at the charges you have had on your account, the people on the phone in the main call centre are usually nice, as it's not *their* money you're claiming, it's yours from the bank, good luck, you'll be fine as you are legally entitled to this information, they are not doing you a favour, it is your right!

ok, well i just called the halifax and ordered 6 years worth of statements and paid £5. And also I mentioned that I had originally sent a cheque for £10 so she said that she would put a note on my file not to cash my cheque! She was really nice! I like custmer service reps like her! So the bank responded to my letter/email dated 29th, the 40 days start from then right?

I phoned Halifax for my statements on the 26th January 2007 and received them today 02 Feb 2007... 7 days in total! I have today sent my prelim off for £1,684! :D Halifax seem pretty quick with statements if you call them:rolleyes:

Ok, here's an update and am quite angry actually. I sent my SAR off on the 29th of January along with my cheque of £10. I then called Halifax on the Friday after the 29th Jan, deciding to order my statements on the phone. I explained to the lady that I had sent a cheque of £10 so she said she would put a note on my file that when they receive my cheque that they won't cash it. So I thought that was fine and she deducted the £5 charge from my account straight away. Then today, I checked my account and have noticed that Halifax had cashed my cheque yesterday, so in all they have taken £15 just for statements. I am going to call them tomorrow and tell them to refund my £10 to the account it was taken from. Ok, so not only that, but Halifax have slammed huge charges on me this week for £130 so now I am overdrawn, and they sent me another letter saying that because I am overdrawn they are going to charge me another £28, so I am sooooooooooooooooo angry because I am not working ( am currently looking for work) that they have now taken the last of my money. Oh my, I am soooo screwed up at the moment.....:???:

I am so sorry to hear you news hun.. Halifax really have to get their communication problems sorted out with regards to the statements. I feel awful I suggested to call them now :( .. It is just that it worked for me.

 

As for them taking all those charges out in one week, that is just awful.. I really hope you are ok and they refund the £10 taken for your S.A.R - (Subject Access Request) request.. Just think it will be that much sweeter when you get it all back.. Although I know it does not help you right now..My thoughts are with you hun XX

Thank you so much for your concern,:p and yes life will be much sweeter when I get all my charges back:cool: , looking forward too that and it will help me so much until I find some work (which I am hoping soon godwilling). I am going to call Halifax tomorrow and they have to refund me immediately, I will not wait as it is on my file that the cheque shouldnt have been cashed:o ! Anyway, will wait and see what happens just hoping to receive my statements soon, actually looking forward to the calculations because I am sure they owe me loads!:p !!! Will keep u updated anyway! Once I have got my charges reclaimed, I am closing my Halifax Account, have wanted to leave them for a long time so GOOD RIDDANCE TO BAD RUBBISH i say :)
