Just to up date you all I have today issued a LBA againt the Halifax giving them 21 days to respond on behalf of my husband for £715 charges and Interest £499.79 total £1214.79. This account has been paid in full last year so I hope that they will still pay up. If not a MCOL will be issued.

I will keep you all informed of my progress.

Will be interested to see your progress. I filed Prelim letter today for £775 & default removed also v Halifax card services. ant claim the interest though until I issue which is diaried for 18th December. Do you know if others have recovered v Halifax Card services?

I will let you know the outcome in due course.

I have sent the LBA without doing the prelim letter and have added my interest which they charged on the card statement. The 8% interest I will add to the MCOL should they not cough up, I have given them 21 days to respond that takes them to the 10th December 2006. This is a closed and paid up account so any money returned is a bonus. Having read other sites some people have done it that way and have been quite sucessful.

Anyway I am sure the way you are doing it will also work and I wish you lots of luck and hope that they respond to you quickly.

I dont expect any response until MCOL, my account is also fully paid up. Notice that the charges were £25! How can they possibly justify that?

Received the usual standard letter from Halifax today, basically saying that the charges were agreed to at the time of the agreement.

Have written back telling them in no uncertain terms that if the money is not paid in full by 10th December(which was the original deadline) then court proceedings will commence.

After issueing a LBA ON 19/11/2006 the Halifax Card Services have answered that they are prepared to offer £300 IN FULL AND FINAL SETTLEMENT, figure actually claiming in total £1217.75. The bigger laugh is that the acceptance form states that the money can only be paid into a Halifax Account. Strange that the account has been closed and paid off for some time now so where are they going to pay it to. So that is a definate NO NO.

The LBA will be issued in the next few days.... so the fight is on.

Just to let you know MCOL has been issued today agains Halifax Card Services for Charges £715.00 plus Interest £509.04 Total £1224.04 plus Court Fees £120.00 Final Total £1344.04

 

 

HALIFAX - Kofi from Halifax legal services have telephoned to try and come to a settlement and did not want to pay 18.9% interest and only wanted to pay 8%. This was the final day that the defence had to be in by. After a lot of toing and frowing they agreed that as the account was closed and fully paid up they could not pay it in to that account, my hubby suggested that they TT the money straight into his current bank account, no they said too expensive, the second suggestion was to send a draft, no they could not do that either, finally, he found that my husband had a card cash account with them which he does not use and they said they could put the money into that account and that tomorrow being Friday he could go to the branch to draw it out. He asked for this in writing - how difficult is this with the agreement that he could draw it out all in one go as it was over the daily limit, they were unwilling to put anything in writing. So tomorrow he will check to see if the money is in that account. If it is not my husbands account tomorrow he will not be very happy as they promised over the telephone, albeit they did not put it in writing. Has anyone else experienced this with Halifax

HALIFAX HAVE BECOME A TOTAL NIGHTMARE, NO MONEY TRANSFERRED INTO MY HUBBY'S ACCOUNT TODAY AS THEY HAD PROMISED YESTERDAY, THEY RENAGED ON THE GOOD WILL GESTURE AGREED YESTERDAY ON THE TELEPHONE. THEY ARE NOW COMING UP WITH ACCOUNTS THAT HAVE BEEN SETTLED WHERE HE HAS A LETTER IN WRITING STATING JUST THAT, THEY ARE NOW SAYING THAT THEY WERE NOT SETTLED. THEY ARE TRYING EVERY WHICH WAY NOT TO PAY. IT IS A DISGRACE, THEY ARE BEHAVING LIKE IDIOTS. MY HUBBY HAS HAD A BASINFULL WITH THEM TODAY. THEY ARE STARTING TO REALLY GET TO HIM AND ARE WASTING HIS TIME. HE OFFERED TO FAX THE LETTER TO THEM AND HALIFAX LEGAL DEPARTMENT DID NOT WANT IT! (WHY NOT ONE MUST ASK). EVENTUALLY JUST 5 MINUTES AGO THEY AGREED HE COULD FAX IT ACCROSS TO THEIR LEGAL DEPARTMENT. THEY SAY THEY WILL GO TO COURT- (YES I DO NOT THINK SO). WELL IF THEY DO, MY HUSBAND HAS ALREADY TOLD THEM THAT THEY WILL HAVE TO MEET HIS COSTS ETC AND OF COURSE FULL DISCLOSURE! THEY CAN NOT SAY THAT THE HALIFAX ACCOUNT STILL HAS A BALANCE WHEN IT HAS BEEN PAID THIS IS ABSOULUTELY LUDRICUS. THESE PEOPLE NEED EDUCATING ABOUT ABUSING THE SYSTEM AND WASTING EVERYONES TIME.

Whilst not blowing my own trumpet, I had a very good experience with the Halifax. My full amount (£565) was credited to my card account just after I send the LBA.

 

Although they are not sticking to their telling, at least they are negotiating at the defence stage, as to waiting for AQs and court dates etc.

Hi all,

AS v HALIFAX CARD SERVICES

My hubby has issued a MCOL against the Halifax Card Services, they issued a defence stating that they have paid in full on GOGW. Now that posses a big BUT they have transferred the money into a closed and fully paid up account. It was an account which Eversheds Solicitors acting on behalf of the Halifax agreed a settlement with a discount of £700 approx, my hubby paid the figure as they requested in Aug 2005. Eversheds then sent a letter confirming that that account was now closed and accepted the money in full and final settlement. My hubby has faxed a copy of that letter to Kofi at Halifax Legal Services and he does not believe that it is genuine.

 

My hubby has been going round the houses and again spoke with Eversheds who again confirmed to him that this account is dead and burried, he managed today to get KOFI to call Eversheds, they are arranging to send the same letter that my hubby has already forwarded to them.

 

So whilst they have agreed to pay as per the defence, they will not release the money to him which amounts to £1,344. If by tomorrow he does not get anywhere with this Kofi in LEGAL SERVICES, he will try and contact the Chief Executve, I believe his name is Andy Hornby. If anyone knows his direct line or email it would be very much appreciated.

 

Eversheds are absolutley stunned and amazed that the letter which they sent to my hubby in Aug 2005 was not good enough for the Halifax even though Kofi spoke to them on the telephone and Eversheds confirmed today what they had written in Aug 2005 and this was good enough evidence by a firm of Solicitors indeed writing to Halifax Legal Services - their client! however as a gesture to assist, Eversheds have agreed that one of their supervisors will email Kofi at the Halifax just to re-iterate and confirm that this matter was dead and burried. When Eversheds spoke with hubby they told him that as Halifax would have told them that upon the final payment that his credit fiile with the credit reference would have altomatically been marked as satisfied, then there should be no problems with the evidence now supplied. They were surprised by the awkwardness of Kofi in LEGAL SERVICES and the Halfax stance in this matter.

 

Has anyone else been given this sort of treatment by the Halifax and does anyone have the direct contact details for Andy Hornby Chief Exec. Any help on this matter would be greatly appreciated. ANY HELP PLEASE!!!

I'm afraid I am not familiar with Halifax but it seems they are trying it on.

 

I found this in the contact bit but it was dated may 2006:

This one seems to accept e-mails.

 

(James Crosby is the Chief Executive of Halifax PLC).

 

The chief exec may have changed I couldn't tell you if this is right, perhaps anonymous call to the bank to ask the question may reveal this. I'll have another search and come back.

Thanx but already found out he resigned and Andy Hornby took over 31/7/2006. But do not have a direct contact number. Anyway, hubby will get to bottom of it tomoz. They have an absolute cheek to hold back they money when they say they are paying it.

If so I would write rather than ring, or use the email address here. At least you have a copy of this and can use it in further correspondence.

 

Not sure if that helps but it does seem odd. I would say they are trying it on though. Have you any reciepts that the money was paid?

So why do they think he still owes the money. He spoke to someone in customer services today and they have paid all the money into the closed account where he cannot touch it!!! bo hooooo.......

I feel a stiff letter explaining that this is not acceptable and that you expect a cheque within 3, 5 or 7 days.
