  1. Okay dx100uk and thanks for getting back. I think on reflection there seems little point in me claiming any PPI back because any reward will just go around in a big circle and end up where it started, doesn't seem to be worth my time, even just for the principle of rectifying the miss-selling of the PPI policies in the first place. Having slept on it overnight I have come to the conclusion that I will probably no longer pursue my claims any further as there is little point. Thanks anyway for your advice and support.
  2. Nothing to report other than I am waiting back to hear after completing all the questionnaires which were sent to me. Quick question, if any of the money awarded on any successful PPI claim goes towards settling any outstanding debt after completing an IVA 7 years earlier, what happens to the interest?
  3. I've never heard of any garage warranting a customer supplied part, I think only the parts supplied and work carried out by the garage is warranted? I might be wrong but I doubt any garage would carry out such work if that were the case because there are plenty of unscrupulous characters out there who would supply their own known cheap damaged engines etc and plead innocence when it doesn't work and hold the garage responsible for the repairs. When we offered a quote and the customer supplied their own parts, we always stipulated on the quote and invoice that we would not be responsible for the parts supplied by them, thus the customer always knew in advance where they stood. If they didn't agree to those terms then we wouldn't carry out the work and nobody looses out. Basically if a customer bought an engine or gearbox from another supplier, then the contract of sale is between them and usually most suppliers offer a 12 month guarantee with the engine/gearbox. We wouldn't warrant someone else's engine because although you can spot a few issues when looking over it, it would not be possible to know if it is in full working order until it is fully fitted and up and running, that was a guarantee the supplier offered, especially if it was a reconditioned unit. If we sourced a second hand engine/gearbox from a supplier on behalf of a customer and fitted it, we would be fully responsible. All our parts were bought from major motor factors and so if there was an issue we could refer back to them as they would guarantee the parts because the contract of sale is between them and us, not the customer.
  4. I don't know why some garages have an issue with offering quotes? After-all they are only estimates and can go up, and in some cases down. Main thing is that the customer is kept fully in the picture at all times. We used to own a few garages over the years and often we would be asked for a quote to fit an engine which the customer wanted to provide themselves. We always gave them a quote based on the engine being complete and in good working order but we offered no warranty on the second hand unit as we didn't provide it. We would always assess the condition of the engine when it arrived and BEFORE carrying out any work, if it needed any new components we would always ensure the customer fully understood the costs etc prior to carrying out the job. Made no sense to keep anything from the customer as we wanted the work, also never made sense to carry out any work which the customer had never agreed to. Understandable that any customer would want an estimate before committing to anything, and so we always made it as easy as possible for them to make the decision, and if the job took longer than we estimated, then that was our problem. Likewise, if they decided not to have the work done because it was too expensive then so be it, saved everyone hassle and no need to chase them for payment when they couldn't afford it after all the work was carried out. Key to it all is to work with the customer to get the job done and everyone is happy. If they can't offer you a quote without seeing the engine (based on it being in good condition) then go to another garage.
  5. What made them check the roof airbags, especially if they couldn't tell anything about them just from a visual inspection? Seems odd to me that if the HPI check came up clear, and there was no visual sign that the airbags had been deployed then they were obviously looking for a reason to return the car. I bet they didn't pay retail price for it too I used to be in the trade for a considerable amount of time, and so my advice is to tell them to cease contacting you as it is harassment. There is no proof that the airbags have been deployed before they accepted the car, anything discover afterwards could have happened at anytime, besides you do not need any proof etc. We bought cars from the public, and we also traded a lot in and it was always up to us to ensure we did all relevant checks before agreeing a deal. Sometimes we got caught out by customers, but tough, we had the chance and the law is the law, private to trade or trade to trade there are no warranties etc. It's tough on them, but that's the way it is. They are just trying it on.
  6. Hi there dx100uk and many thanks for your reply, that makes absolute sense. The outstanding debts with Halifax after the IVA distribution amounted to less than 4.5k over one loan and one credit card. My PPI claims date back to the mid 1990's and probably cover 10+ years of payments every single month (between £10-£20). I am cool with the idea of paying back everything I borrowed, and so it is possible that there might be some spare left over after paying off a possible £4.5k Fortunately after completing my IVA many years ago I learned to look after my money better and I am financially very very good these days, but this is all about the principle of being mis-sold the PPIin the first place. If it meant I had to pay back at some point in the future, then that is fine, I can cover it. I will keep you posted!
  7. Hi guys, quick question here: I had an IVA from 2005-2010 and successfully finished it and it became statute barred in 2011. In 2013 I claimed PPI from one of the creditors, EGG and they took a chunk of the reward to settle the debt which was written off after the IVA was completed. I understand that they can do this as they were the original creditor and even though the debt is statue barred it still exists until it is cleared, it's just that they can't chase me for the balance anymore. we come to today and I have written out to all my past credit card & loan providers whom I had PPI policies with. One of them, Halifax, I had a number of consecutive loans (only the single final loan was defaulted on) and also a credit card. During the years of my IVA they sold all the debt to Max Recovery, which is normal. My question is this - If my PPI claim was successful, a nd as Halifax no longer owns the debt as they sold it to Max Recovery, can they offset any reward I get to the debt, considering they sold it and have now already had some, but perhaps not all of the money back when Max Recovery bought it off of them?   8. Hi guys, here's my situation: I closed my business down last June and cancelled my telephone & broadband contract with BT, no problems there thank god. Anyway, they have asked for a £44 payment for Netprotect or something. I'd never heard or used this service, but they said that it was taken out when I set up the phone/broadband. My wife explained to them that surely if we have cancelled the phone and internet in June last year, how could we use the Netprotect? They say that it can be used on any PC anywhere. My wife also asked why they didn't mention it when we cancelled last year, but BT said that they were not obliged to and assumed that we wanted to keep it. My clever wife also asked for (and received) a copy of the transcript of her conversation. So, where do we stand, do we just pay it to avoid damaging my perfect credit rating? Many thanks in advance.

Again, I understand what you are saying, but the default date is when I started the IVA in Oct 2005, I kept up all the payments and completed in 2010, and then in 2011 when it was over the 6 year period, it no longer appeared on my credit file. When applying for CC's over the past 3 years there has never been any mention of my IVA. If the bank has access to my Credit file, then they would know that I must have successfully completed my IVA as there is no trace of any defaults on it. I am not applying for any credit, loans or overdrafts, just a standard business account, so surely all that should matter to them is that I am a financially solvent customer and if in the future I apply for credit then that's when my IVA could come into play even though it is Statute In Law?
  11. I agree with what you are saying, but just find it weird how they know I had an IVA without me telling them, but they have no idea when it started/finished.
  12. As always, hoping you can offer me some advice. Had an IVA from 2005-2010, completed it in full and never missed a payment. Got my certificate of completion at the end, all good. Since then I have had a few successful CC's, again never missed a payment, top credit score of 999. Took out a Barclays business account in 2011 as a sole trader, IVA posed no problem at all, never had a problem with any business account. Converted sole trader to Ltd company recently and applied to Natwest for business account and after waiting over a month for my account, they tell me that because I had an IVA, they want proof that I have completed it. It's so long since finishing it that I can't find my completion certificate. Got an appointment to see Barclays next week and mentioned the IVA, they too want proof that I have completed it. Nobody has brought up the IVA since I finished it, many have given me cards etc and my record if perfect. What is the point of me completing my IVA like a good boy when Natwest are going to be so prejudice? I know I could ask for another copy of my completion certificate, but I feel like I am being punished for something which is both private and also unfair as I have completed it 3 years ago. Where do people stand when they have completed their IVA's?
  13. Just install a shredder on your letter box so that it disposes of the card before you get the chance to spend on it, Vanquis are not the answer to repairing a credit rating, they will more than likely trap you into something so you end up in financial troubles.

  15. Having been an honest Vanquis card holder for many years, and never defaulting on a payment, they still treated me badly when I decided to close my account. Personally, I wouldn't never recommend them. It's an easy card to get, but extremely difficult to close your account and rid them of any debt, believe me they are very economical with advice when it comes to leaving them, DO NOT TAKE OUT ANY ID PROTECTION OR ANY OTHER PRODUCTS WITH THEM. Beware!
  16. Well, I decided in the interim to email my complaint to them, and they responded fairly quickly with a standard response to contact them by telephone. I contacted them this morning and they said there was now and outstanding balance of £20.59...for a card which I have not used for over 6 months. I was furious, but kept my cool. I explained that there was no point in paying because they won't carry out my instruction to close the account, but she said they couldn't because there was ID Protection on the card which was nothing to do with them, and it was my responsibility to ring ID Protection to cancel it. I did point out that it was originally taken out via Vanquis Bank and did not require me to call ID Protection when the card account was open. Anyway, I called ID Protection and got the policy cancelled, they said it would be sent to me in writing. I have been assured that my account will now be closed, however, I doubt it very much but we can live in hope.

  18. I've got exactly the same issue, been going on 4 months now. I've asked them to cancel all the protections etc, but they ignore me. I have put my account in credit numerous times, but they just won't cancel. Any news on your situation?
  19. To cut a long story short, had a successfully completed IVA from 2005-2010 took out a CC with Vanquis in 2011 to help repair my credit rating, barely used it all the time I had it. I've got an unblemished credit record since a year after ending my IVA and have never defaulted on anything. I decided to close my Vanquis account on 10/2/14 by telephone after doing a balance transfer to another card, therefore not owing a penny to Vanquis. I also cancelled the ID Protection & Repayment Option Plan at the same time...they didn't do as I ask at all. I am now stuck in the trap I have read so many other people are in whereby Vanquis keep adding fees, interest etc until the account is settled, but no matter how much I pay, it never seems to be settled, so they keep adding more. Since 10/2/14 I have paid the following to settle the account: 19/2/14 - £40.65 25/2/14 - £6.00 13/3/14 - £22.98 10/4/13 - £10.00 Today, they rang up a few times asking for an outstanding amount of £1.07 but each time I try to discuss the account with them, they just hang up! I have written a letter demanding that they close my account, I have also enclosed a cheque for £10 and enclosed my Vanquis card all cut up. I will send it signed for delivery. Other than that, I don't know what to do, they are just forcing me to give them money each month. Any advice?

  21. Thanks for the replies, much appreciated! Thought I would give a quick update. We emailed the head office last night to say that unless they have collected their bin within 7 days, we will be charging them £1 storage per day that it remains on site. We got a reply first thing this morning from them apologising and also saying that they will sort it out asap and refund our money. So, looks like we may finally have a result! We will now of course remove them from all our other sites and use another company.
  22. Hoping someone can offer advice. Cut a long story short, wife and I own a few businesses in the South of England, and we use environmental disposal companies to collect our waste from each site. Set up our latest business in July 2011, arranged a 12 month contract with Veolia to supply a container bin on site and to collect fortnightly. All was well until October 2012 when they changed the dates, times and frequency of the collections without informing us. They then sent a invoice claiming to have collected the bin four times in one month, and also claiming that twice in the same month they were unable to empty the bin because the site was locked up, but how could we ensure it was available when they are only supposed to collect fortnightly and within working hours? We disputed this via phone and by letters, but after countless calls which were either not answered or returned during November or December, we wrote to them cancelling the contract and direct debit, primarily due to them defaulting on collections. They put us on stop even though we had cancelled the contract in writing, but they refused to discuss anything unless we paid up for oct, nov & dec, even though there were no collections. To date, there have been no collections since October. We have paid up to end of December, the bin is still on our site, they have cashed all our cheques which went with the letters. They have not responded to any of our correspondence, they keep sending invoices for a fee for 'duty of care' each month which relates to sorting and disposing of our rubbish, which they have not collected. They are now threatening legal action if we do not pay for January and February, yet they are the party who are delaying the process and not acknowledging or carrying out our instructions to cancel the contract. We are running around in circles, never had such bad customer care from a business as this. Any advice
  23. What date did your IVA start? Oddly enough, I got a letter from Egg as well stating that my debt is now with Britannica Arrow even though my IVA finished over 8 months ago.
  24. Just a quick question. I had a 5 year IVA from November 2005 which finished in November 2010, all creditors were satisfied that I had completed it and I had the usual court order to confirm that it was all finished. On checking my credit file, there are still defaults from Egg dating back to February 2006 and they still are adding defaults each month even though they have stated that they were satisfied with my IVA. Should they still be on my credit file? Where do I stand? Thanks
