    • Their FAQs state - Cancellations and modifications If your booking has been cancelled, Booking.com refunds you immediately. The processing time may take 7 to 10 days and depends on your bank. If you have questions, contact your bank directly. I'm a regular Booking.com and AirBnB user.  The former have never cancelled.  The latter have and my money was refunded immediately (not that that helps you as we're not talking about AirBnB!) Best to check with your bank and see (a) if you did pay in advance and (b) if it has been refunded. Also, have you received a message from Booking.com officially stating the cancellation?
    • I'm not up to date with the Legal Aid rules but I'm not sure that many people qualify. HB
    • You question timescales a bit in thread - From my experience, defaulting everything and ignoring all non PAP letters, while making no payments: - 18 months to LOC - further 18 months to be at court Most are still silent 3 years in though!. If making token payments, court, if ever would be 4-5-6 years from now - Hope that helps. My debt is similar, I started it 2021 and wouldn't believe I'm already over half way through default period. You need to make the decisions but follow advice already given in this thread, and you will be fine. Best time to plant a tree was yesterday, second best time is today. Good luck BT

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I reminded Bill Wareing of the conversation and his promises to you when I spoke to him yesterday. He knows his name is on the boards now as is his telephone number hehehehe. he is a reasonable man, guess he has to be as his department are getting the flack caused by the likes of UATOB Claridge is causing. I hope Monday is a non event for you. Open the door to a cold caller while in drag, that would certainly put him off calling again...LOL..

No not bankruptcy at all or an IVA, no need for those. This is coming right out of left field and will hurt them even more and it placess them in Default . BW told me I cant issue a default against a bank, and I reminded I had and it remains in place with the CRA's, because that my children is the law, all legal and it's on the statute books. Oh it is a goody. I am counting the days to the 26 February. 2007 is going to be a very good year. Someone else is waiting until January 31. Oh happy days.

No call from Bill Wareing yet, if nothing by 4pm, I'll call him.

Cant leave any any longer - in hospital for a nose operation tomorrow, out of action for a week after. Wouldn't be able to see the screen let alone make any sense of what I'm doing.

Well good evening ladies and (very much) men!

 

Ta Da.......

 

Bill Wareing called me this afternoon and....

 

Offered a full refund of all charges fees and interest charged back to the account (in principle on without prej no admission of improper conduct etc etc)...

Has also confirmed (on request) that any adverse credit marks on the account re late payments due to insurance company delays, and threats of default and notice of delinquent account will be removed! He said that the offer is based on the most I would be able to achieve in County Court and would provide a full breakdown.

 

Howz zat!

 

I of course thanked him for his productive intervention, and requested all the above in a formal offer in black and white (along with the now available copies of all bank statements and a copy of my cca) for me to peruse and confirm in writing.

 

Thank you all so much (expecially battleaxe, priorityone and iwannabe) - couldn't have go the result without you.

 

Not to be a killjoy, but... once I receive all the above paperwork, can I request the settlement by cheque (method is that I would be able to cash it, pay 95% back onto account and be able to donate the 5% to CAG!) {I have not a penny to my name for a donation :-( }

 

Was it a little too easy to get this settlement from Bill (although I know that I had some strong support from Battleaxe) or have I almost won my case without going to pre-lim stage?

Fantastic news regarding the result via Bill Wareing. Just goes to show what can be acheived and hitting the right person in the establishment.

 

Of course you now have the option of the Section 85 CCA, just to make things a bit tighter and getting MBNA to squirm. This will net all interst applied to the account since whenever a second card was issued to you. Isn't this the best savings scheme you have ever had?

They don't want to set foot in a court room.

 

I am also wondering if the result was because I have also spoken to BW about you being a friend of mine. Nothing like stretching it a bit.

 

Yes, you can ask for the money by cheque.

 

Nah, forget the gender the reassignment, just live life on the wild side for a while. I have some lovely five inch stilettos I don't wear anymore. I am willing to give them to you, to enhance your new image.

Once I receive that (and all the statements etc he's promised) I'll be asking for the cheque.

 

Battelaxe - not quite sure what you mean by s85 (of what act - and what would I do with it?)

 

This is my last posting, due to hosp in 30 mins.

And no it's not cosmetic either (sinusitis for 11years)

Lilly, Ssection 85 of the Consumer Credit Act, if this is to do with a credit card. MBNA are definitely in breach of this one.

 

Oh yeah that is what you are telling us, 'not cosmetic'. This is part of your cunning plan to remake yourself. LOL..

 

Seriously you will notice the difference once the sinuses are cleaned.
