    • It is an interesting Final Notice. Firstly because there is usually a reminder Notice before the final Notice. Secondly because it contains some of the wording that should be in the original PCN [aka Notice to keeper]. It could be that the necessary wording in the NTK is missing so they put it in the Reminder Notice to cover their error. If they have it hasn't worked. But the only wat we will know if you post up the back page of the Notice to keeper along with the other details asked for on Post 8 .  If they have got it wrong it means that they are unable to transfer the liability to pay the PCN from the driver to the keeper . I take it that you are the keeper and not the hirer? And do you know how long you are supposed to stay in that car park? In the past I have found Sainsbury's pretty good at cancelling PCNs for their customers. Take both PCNs in to the store and point out if you are a regular customer and that the driver spent a lot of money in their store and see if they could please do something with the ticket for you. if the manager can't help, then come back and we will give you their Head office and write to them. It is the easiest and quickest way to get the ticket cancelled. No point in appealing since that would mean they lose the chance to make any money out of you which is their whole reason for running the car park. If you cannot get Sainsbury to cancel then we rely on ECP getting things wrong so that you don't have to pay  on a technicality or technicalities. For example if the PCN does not comply with the Act and the keeper is not then liable it makes it difficult for ECP to win should it go to court as so many people are legally able to drive your car and Courts do not accept that the driver and the keeper are the same person. Which is why we do need to see the questionnaire filled in and the rest of the NTK. Also it would be helpful to get photos of the signs in the car park. Ones that can be read by us, and the sign at the entrance as well as the inside ones especially those that are worded differently. Poor signage is another defence that works well and you will  need a good defence should they decide to go to Court.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received exactly the same letter from nationwide but mine was dated 6th march 2007.

 

still no credits into my account though, which I find fanscinating because I can go online and transfer money from my nationwide account into another nationwide account instantly so why does it take them over 6 days.:-? :-?

I have not received the letter, but my charges were refunded to my account yesterday, shown on my flexaccount online as " correction".

 

I also claimed for my court fee of £30 (MCOL) how does this get repaid ????

I issued 26th February.

 

Received a letter this morning informing me that a correction had been applied and a refund of charges had been made, and that the MCOL fee would be refunded within 5 days.

 

Also told me that if I did not comply to the rules of my flex acount that they would issue 30 days warning of intention to close my account :p

This OFT decision will mean nothing. They have to demonstrate that they are not overcharging. The only way they can do that is by divulging their costs which they won't do (cos it prolly doesn't even cost them £1).

 

The OFT cannot make a legal precedent. It can only provide it's opinion. Unless banks demonstrate what the real costs are, the claims will continue.....

So i recieved a letter from nationwide today dated the 14th March. It said that they could not refund any charges as it would not be

 

'Treating customers fairly'

 

I find this funny as one of the FSA'a principles is around treating customers fairly. and the way that they refund charges after taking them to court certainly is not fair for all the others that give up on the 1st letter, or dont ask for them to be refunded.

 

 

So i phoned them, to enquire why i had rec'd this letter 3 weeks after filing a court claim against them.

 

They went on to say that they had 'No record of a claim' I then explained that they had as they had acknowledged on the 28th FEB so they must have.

 

They then went away and she came back to say she had found it.

 

She then explained that every time they get a customer take them to court, they acknowledge then the details basically take a while to be added onto a sprreadsheet by there administration dept. After that they become part of a 'refund' Queue. She then confirmed that the money would be in my mums account in the next few days.

 

So those who else are waiting, it wont be long!!!!

Just got my ackowledgement sent today stating Nationwide (Mr Bacon) intend to defend in full I am presuming by reading other posts that this is another one of their letters before they submit their defence as "paid in full". Still they now have until 2nd April to submit defence so I better get up to speed on the AQ just in case.

I know there are a few loose ends to tie up now with the court, etc. But i don't have to be pro-active anymore cause i've got my money. So any comments about tying things up would be appriciated...

Hi there, great informative thread!! Could someone please give me some advice? I have been through the process of claiming my charges back from nationwide, I am now at the court stage. I submitted a claim through mcol for £4K!!!, and received an Acknowledgement of Service today dated 14th March, stating that nw intend to defend the claim, and they now have 28 days from the date of service of the claim form to file a defence - does this mean 28 days from the 14th March? Plus what happens now do I just sit tight and wait?!!!

No, I beleive that the 28 days is from when the claim was 'deemed to have been served'... see your court papers... Not 100% on this though.

Apparently it is a simple process (said the lady in the court who happens to be claiming against her bank). I am right behind you and hope I will get mine soon. You will.. sit tight and keep us updated!! Smoking is going well- if you mean smoking as is having the occasional lapse hating myself, feeling crap, getting remotivated then lapsing again. Difficult at the moment.. but soldiering on!!!

Ok... I just rang the lady @ my county court to confirm what the process was for tying things up and she advised me to put in writing that i wished to withdraw proceedings against Nationwide as I have received full settlement... Which I did.... thought this might come in useful.

I claimed all interest fees back on behalf od my Daughter (£880). I had them refunded along with all of my charges exactly one week before I was due to appear in court. Ironically during the process I was charged £30 for a bounced cheque. I am starting court proceedings tomorrow (Monday 22nd April) inspired by my daughters result. I called Nationwides head office and tried to get through to them the futility of refusing my request to credit the money back into my account. If everything goes the same way as my last claim it is going to end up with them paying around £80 back into my account with court costs. I was told the policy basically is to do things the hard way. The point I am trying to make is that you will have to see it through to the end. The banks are hoping that you will cave in before it gets as far as a court case. Go for it. No matter how little the amount. Its not just about the money.
