I know that on Facebook you have been advised that you have very few rights – but this is not true. Apart from anything else, it's an offence to sell a vehicle which is not in roadworthy condition and it sounds to me as if your vehicle is not in roadworthy condition although we may will have to get an independent inspection. I understand that you had a mechanic give it a pre-MOT cheque. Was that before or after it was purchased? A few problems here – first of all, the van was very cheap. This doesn't reduce your rights anyway but what it does mean is that it may be less worthwhile taking an action that we will have to work that out later. Secondly, you bought the van from a dealer about 130 miles away. This means that if it has to be returned, there is a 130 mile trip to get it there and then you have to come back. You won't feel good about it but you may as well learn something for the future and of course other people who visit this thread for that as well. Finally, if we end up having you bring a claim against him in the County Court, I have no doubt but that you will win but enforcement could be tricky. I think the first thing to do is to consult the land registry web search service and find out if he owns the property that is trading from. If he does then at least you have identified an asset and enforcement will be much easier. You can access the land registry website here Summary of freehI think it will cost you about 3 pounds.old - Search for land and property information SEARCH-PROPERTY-INFORMATION.SERVICE.GOV.UK I think it will cost you about £3 or so. Make sure you use the website link I have given you above. It is a government one. There are lots of private websites which look as if they are government and they charge you a lot more money for giving you exactly the same information.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there folks! I am new to the site. Not only am I looking for help & support, but I hope I will be able to help others in the near future! Im quite clued up on mortgage advice/good deals etc if any body needs help.

 

I have a huge problem at the moment with Welcome Finance and have been desperately trying to find out if there is anything I am able to do.

 

My dad who is knocking on 50 is probably one of the nicest most placid people you could ever wish to meet and same for mom. They have both worked their butt's off all of their life and have never had any luck financially since I can remember.

 

The Welcome finance problems started when my mom was made redundant- in the most unpleasant fashion last year- although she is now working again, they are still trying to get on top of things and she doesn't get paid as much so there is still quite a shortfall.

 

They have a secured loan with Welcome finance and I am so at the end of my tether- I have been taking calls on their behalf and taking trips to the office with them as and when Welcome have requested.

 

They originally took out a loan for 10K with Welcome, unfortunately I had a very sticky patch a few years ago so to try and help me out they renewed their loan to surprise me with 2K to help me out. They have been messed around from that point on. When they renewed, Welcome made the new agreement out for 15K (and added on loads of crappy PPI which they didnt even know about- and when asking if they could claim for mom were informed it only covers dad!) When they collected their cheque they were told that because it was a day later than what they expected - (The day they had told them to go in!)the amount they were receiving was approx. £800 less than they had been told as all the interest had changed and gone on etc... whatever this means. They desperately wanted to help me- so swallowed their excuses- boy do I wish I had known at the time!

 

With moms job situation the loan is now financially crippling them- they had to make a few 1/2 payments here and there and they tried to look at consolidating it to reduce the very huge payments. Welcome also offered to spread it over a longer term to help them! and told them they must make 2 full payments and then they would do it. So we managed to scrape it together and went along to see the manager- who then informed them that things had changed and he would no longer be able to do it!

They are constantly hounding them with phone calls - at home - at work - they almost got my dad the sack of which I have informed them that if they continue to do so- he will be out of work and they will deffinately not receive anything at all then. They have turned up at the house uninvited and asked my brother for the money! they asked him for my address so they could come and ask me for the money - lots more but dont want to bore you etc.....

 

We have written in to them offering to pay 17K(through re-financing) in desperation and they said they would not do it. Now this is the part that I find offensive:

 

The new agreement was for 15K although they have only ever taken 12K in total from Welcome.

 

Their monthly payment is approx. £423 per month!!!!! Loan is apparently over 10 years but that will never happen.

they have been paying this for approx. 2.5 years = approx. £12690

 

their old monthly payment on the 10K was approx. £283ish paid for around 12 months = £3480

 

(PPI was approx. 3K I think - of which he knew very little about but was informed they had to add this on)

 

And the joke!- their redemption figure is....£23500 at the last request but it has probably gone up even more now as they have told them that until everything is in line they will just keep adding to it.

 

I have seen my dad in some real states- not sleeping, eating panicking and really quite poorly and I cant bare to watch it anymore he really doesn't deserve this. As they have pushed the amount up so much nobody can re-finance it and Welcome are just torturing them with harassment and threats to take their home.

 

I have written into them asking for T&C's, copy of agreements etc. to no avail.

I have spoken to FSA - couldnt help

Cit advice- couldnt really help

Trading standards didnt know what was extortionate

Head office- wont deal with it referred to branch

Branch: different story every time you speak to them.

 

Does anybody have any ideas or reccomendations for what I could possibly do. Life is really too short for this and I cant bare to watch my parents go through this any more.

There are lots of us in a very similar position, so tell your parents not to feel alone.

I would start by reading the thread "Welcome Finance Any Dealings?"

Sorry cant insert the thread but I am sure that somebody with more skill than me can! Its in the Debts & Bailiff section as well.

Then hopefully all us Welcome Freedom Fighters will be able to help!

Hi Lou-Lou,

welcome to the forum, we will try and help you in any way we can, as Grapes has said there are quite a lot of us fighting Welcome at the moment so have a look through this thread.

Welcome Finance any dealings??? Theres plenty of help and advice from loads of people. The Welcome Fredom fighters are a pretty firendly bunch, unles they are dealing with Welcome ;-) so dont think your parents are all alone on this, if they have access to the internet let them look through on here too, it will hopefully allay some of their fears.

Friendship costs nothing but its rewards can be priceless. Do not judge, as you will not be judged but if you can, try and assist where possible.:smile:

Thanks ever so much guys! I have been reading through that thread, I cant believe how many people have been treated so badly- whay an awful company!

I presume you would reccomed againt this but just wanted to know what you think-- Dad had a call this morning, they said they have run his details through for a new package they have and it has been accepted. They told him to go in to the office on Monday and they will re-new it, stretch it out over a longer term and he may even end up with some money in his hand too! - I do not want him to get into any further trouble with this lot and they are now trying to tease him in by saying it will lower his monthly payment. Do you know if this will also change his rights as it will be a new agreement as his last was taken out about 3 years ago. The trouble is with these people is you are always thinking what are they upto. I have also requested a copy of T&C's and a copy of the agreement in the past of which they failed to come up with. What do you think guys? I'm not sure which steps to take next.

I think when push comes to shove you have to make your own decision but we have been down this route and basically it is just a way to make Welcome money and nothing to do with helping your dad. They just know he is at breaking point and want to take advantage of him. They told us exactly the same thing and it was nothing like what the b**t**ds did! :mad:

 

They will give him a new loan so he has to pay off the proceeding one, its not a renewal of the first one or an extention or anything like that, whatever they say, check the paperwork. So he will not only pay off the outstanding sum minus a few SMALL refunds for any useless insurance he may have been persauded to take out. They will charge him a penalty fee for closing the account early that adds to the amount outstanding.

 

They will charge him an acceptance fee for the NEW loan, then they will try to squeeze him into taking more insurance and they will prob have a cheque there to balance up the sum he has "borrowed".

 

Do I like them? Nope not at all, been there and been burned. They told us the payments would go down and the period would be lengthed, then when they arrived it was the total opposite.

DO NOT GO INTO THEIR OFFICE - IT IS THEIR TERRITORY AND YOU WILL FEEL INTIMIDATED. DO NOT PHONE . SEND EVERYTHING IN WRITING RECORDED DELIVERY.

instead sit in the comfort of your own home , take your time, and do not feel frightened by their threats, yes it's hard but you and your parents do not have to be treated like this!

as grapes says there are a lot of us who have been through it with welcome.

Hi there, thanks again! I am now going to advise him against going into their office - you are right - why cant they send their proposal through the post? so we can pull it to pieces in comfort.

 

Do you think I should start by sending in a SAR? as when I have previously requested a copy agreement they have never sent it- or doesn;t it really matter when it is secured? I just have a funny feeling that they do not have it and there have been so many changes in staff and people getting sacked etc. it really makes you wonder...

If an SAR is the right way to go- where do I go to get a good template - sorry I am new on here and although I am spending great amounts of time on here to feel my feet I do not know how to get into the templates I have heard people mention. If they do reply to this request is there anything I could possibly do them for to get this sorted after reading what I have said. I would love to have it out with them in a court room point blank- but I done know on what grounds would be best.

i would also send a copy to your local branch to inform them what is going on- do not forget the tenner to head office.

also a handy tip is use your customer number rather than any specific agreement number.
