Got my list of charges which totalled £955, sent them the first letter and received no reply, so have sent them the LBA on 2nd January. Do they usually ignore correspondence.

Hi,

 

You usually receive some sort of offer, when did you send your first letter?


HSBC - S.A.R - (Subject Access Request) 30/10/06

 

07/11/06 - Letter refunding cheque and informing statements will be along shortly.

08/11/06 - Statements from Jan-2001 to Jan-2004 rec'd. Requested more but am waiting.

09/11/06 - Sending of prelim request for refund! £913.50

27/11/06 - Letter from Royal Mail, original prelim lost in post!!

06/12/06 - Another prelim sent :(

19/12/06 - Reply from Mr Langdale saying complaint received and that I'll have a proper response by 5th January 07....

 

Capital One - S.A.R - (Subject Access Request) 31/10/06

 

Sent off prelim for £392.00 - All adds up I suppose! 06-12-06

Partial Offer received 19/12/06 - £152, offer accepted as part settlement only......

 

GE Capital Bank - S.A.R - (Subject Access Request) 31/10/06

 

Store card account. Charges approx £200, prelim being sent off in the new year!

They will probably find it later in the year when they get the Xmas decorations out again;)

They probably get sack loads of these letters every day. Did you send your first letter by special delivery and was it signed for.

In any event you must stick to your timetable and not theirs as they will string you out right to the end. I got paid out yesterday by Capital One and started my MCOL at the beginning of December.

Like another poster said Cap1 probably got lots of letters lately there was something in the Newspapers last month that these complaints to banks are increasing etc.. - and it's been Christmas too (which doesn't excuse their bad manners in not replying does it?) - Keep going with your claim and stick to your own timetable - don't let them influence you into backing down!!

 

Like DS said remember to record the delivery of letters (costs a pound) then you have proof you wrote to them with the signed for dates etc..

 

The best thing to do here is keep reading as you'll learn the "quirks" and stall tactics that these banks and companies use etc.. - if you get stuck ask as there is always someone here who will have an answer or be dealing with a similar reply from a company. There are lots of really good Cap1 threads to help you through this!!

 

You will win your money back - if they defaulted you make sure you ask for it's removal etc.. when you write and when you make your claim too!!
