Hi all

I got a parking notice in October for parking in the Gallagher retail park for watching a movie that lasted more than 2 hours that I appealed.

I had shown my tickets asked Odeon staff if okay to park outside as I did not see any parking restrictions and they said it is okay.

I never heard back the outcome of the appeal from Horizon parking and now I have this notice from Debt recovery Plus, which is double the original ticket amount. 

Is this considered the claim?

What is the best advice to proceed here?

Sadly PPCs hardly ever allow appeals and they've wasted your time.

DR+ can't do anything to you; ignore them. It's best to sit on your hands unless you receive a Letter of Claim. If one arrives, please come straight back here and we'll advise.

Do you have the original Notice to Keeper from Horizon?

Everything I received so far is attached in the pdf.

DR+ mention previous notices but I have not received any thing other than what is attached here.

I do not have the copy of the appeal that I submitted as it was an online form but I have the acknowledgement email of receipt of my appeal by Horizon - added to the attached PDF.

In the acknowledgement email they say that the parking charge notice will be on hold until they respond to the appeal. I never heard back from them and received the Debt recovery notice instead.

Also, I don't know if this is of relevance but I noticed in the forums that you should receive the parking notice within 14 days of the contravention and I received it on 15th day (i.e. 5th October). 

Grateful for the advice.

the PCN is within 14days

 can't comment on the NTK as you don't have it.

can i guess that you outed  yourself as the driver by saying things like ---i did this ---, i did that on the appeal?

As the PCN was apparently posted 6 days after the alleged breach it will be deemed to have arrived two working days later. so even if it is delayed in the post for whatever reason, you will not be able to claim that it arrived outside the time for qualification under the Protection of Freedoms Act 2012.

Not to worry though because the PCN does not comply with PoFA 2012 so the effect is the same as if  the PCN lawfully arrived outside the 14 day term. In other words Horizon cannot transfer the liability to pay the PCN from the driver to the keeper.

As the Courts do not accept that the driver and the keeper are the same person it becomes difficult for Horizon to prove who was driving as thousands of people are able to drive your car. It is important that you do not reveal who was driving by writing to them and stating "I parked the car.." rather than saying that "the driver parked the car".

Well done on not outing yourself as the driver.

Horizon rarely do court, and if they were stupid enough to do so you have proof they broke their own trade association code of practice by refusing you the chance to appeal.

simply await until/unless you ever get a letter of claim with a reply pack wanting I&E 

if so comeback here.
