I have just had the following letter from Crapital One:

14th March 2007

 

Dear Mr. T,

 

Your claim against Capital One Bank (Europe) plc

County Court Claim number 7WR03176 (6WR03176 is actually correct)

 

I’m writing to you in response to a settlement you have agreed with our Legal Specialist regarding the above county court claim you have issued against Capital One Bank (Europe) plc. (well that’s funny as I can’t remember agreeing to it yet, last time we spoke I refused your settlement offer and sent the cheque back to you stating that I was not accepting it until you agreed to remove the inaccurate Default notice from my credit file)

 

As agreed, I have contacted our credit file amendment team to ask them to remove the default from your credit file. (Better make sure it is from all CRA’s as I will be checking and will be requiring written notification that this has been done) Unfortunately, the credit file agencies only allow them to update and amend credit files at a certain time each month. I have asked them to write to you to confirm when they have removed the default from your credit file. In any event, the default will be removed very shortly and you will receive confirmation of this from us.

 

I have also enclosed your previously returned cheque for £295.70 and arranged to send you an additional cheque for £9.12 (as I told them last time they sent it that it was missing the daily rate of interest that had been accruing sine I filed my claim), which will arrive within the next 14 working days. This further cheque will cover the 8% interest you are claiming under section 69 of the County Courts Act 1984 from when we previously wrote to you confirming the refunds had been made up until today’s date. This amount is £0.16 per day as stated on your claim form.

 

If you have not already done so already, please notify the court of the settlement in order to avoid further action. (Not likely until it has all been done and the default has been removed and also the other cheque and this one have both been received and cleared) Alternatively, please let them know we are settling and notify them to discontinue the claim once you receive the letter from our credit file amendment team and your further cheque. (This I will do, know your thinking along my lines)

 

Once again, I am pleased we have been able to resolve things and I wish you all the best of luck for the future. (Well how nice of them to say this, I wish them luck to as I’m sure this wont be the last claim like this to hit their HQ) (I wonder if the card I have in my wallet will now be activated as it is a new card and as I was over my limit it couldn’t be activated…….ummmm I wonder)

I give advice not as an expert on law, only as a guy who succesfully claimed back £3385 from The Halifax. Followed by another £2611.

 

Lloyds TSB settled in full before hearing

 

Cap One offered full settlement and default removed.

Gonna send a letter back first telling them to resend with correct claim number on, as it had a 7 instead of a 6 at the start. Want it right before infoming the courts, just in case.

 

Great! but you are not giving up on the £100.74 are you?
