By reason of the Termination of the Agreement by the notice, defendant became liable to pay the sum of £7502 7. The date of maturity the agreement is 24th August 2027. 8.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Cobbetts must be moving up a gear since I replied to their defence on the 29th they have sent me an offer of just over half with their usual stipulations that this is not with their client admitting liability and I must not disclose this to any third party - hence I came back here - the only thing that bothers me is they state in the letter if I decline this offer they will bring it to the attention of the Court??? Is this normal.

I'm not sure, but I received a letter about 5 minutes ago from Cobbetts offering about half and the standard keep mum stipulations. Not sure what to do next,:) but have received great advice from Deller and ataction regarding the AQ. It's here if you're interested. Gotta go pick up my daughter from school but will have a look when I get home. Did you not get an AQ? I didn't get the CPR18.

I got the defence above on my thread but haven't had an AQ - how bizaree. Don't know what to do now the money would really help out after Christmas and all that but if I hold out for the rest it would be double handy!!!!

 

Can anyone help me that has been at this stage before and tell me how much longer you think it will take???

Yes this is totally normal so don't panic, send them a rejection of settlement letter as below, then follow the advice regarding AQ's I gave trish.

 

Thank you for your letter dated xth January 2007.

 

I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, interest and court fees, which together with the daily rate of £0.XX now total £xxxx as of XXth January 2007.

 

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.

 

I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim.

 

I am also not prepared to agree to any confidentiality clauses you try to impose, unless of course your client wishes to make an offer of due consideration in addition to the amount of £xxxxx, in order to be afforded this privilege by myself.

 

I trust this clarifies my position.

I assume you're refering to the daily rate. Calculate from the date you filed your claim through MCOL, then add this to the total on the MCOL claim, then this will be what the total is to date. Is that clear??

To give you some sort of guidline, my claim was settled 15 days after the AQ deadline, so at a guess I'd say about 4-5 weeks!!

I sent a standard CPR 18 defence back on the 29th and I received an offer of half on the 3rd so I think they might be pulling their fingers out a bit. I have declined their offer today so now I will have to wait for the AQ I suppose.

How long did you have to wait for your AQ Deller? If I filed on the 16th and they have defended it I have lost track of my deadlines. Does it rest with the Court now?

Interesting that you got an offer in response to your CPR18. Perhaps even mildly disappointing as I thought for a moment it was my brilliance, charm, wit and steamroller letters that were doing the trick!!

I actually received my AQ 2 days after receiving Cobbetts defence, but they do seem to be taking a little longer at the moment.

Ok moving on...

 

Cobbetts sent me a letter with their AQ attached on the same day I declined their offer.

 

On the AQ the last day for filing is 7th Jan but I still have received nothing from the Court is this normal???

 

Cobbetts have put in their other information section that I have not served a reply to their request for further information that was due on 2 January 2007 - which I have I faxed and posted my particulars of claim again!!!

 

What should I do fax a copy to the Court and state I have supplied this previously or wait for my AQ from the Court??

 

Sorry gettin worried now that I might have missed a deadline or something!!!

My God they're getting desperate!

 

Your claim is under £5000 so it won't go anywhere other than the small claims track so you don't have to respond to the Part 18 request, as you have already replied (CPR Part 27).

 

If you haven't received your AQ to complete, you need to ring the court that is now dealing with the case as the deadline for filing normally applies to both parties. Don't stress about it though. The court system is as much at the mercy of the post office as the rest of us and they should make an allowance for that but ring them today and see what's happening.

I have just spoken to the court and they apparently sent my AQ on the 19th December but I still don't have it - they are going to send me another one and I need to get it back ASAP.
