    • Well we can't predict what the judge will believe. PE will say that they responded in the deadline and you will say they don't. Nobody can tell what a random DJ will decide. However if you go for an OOC settlement you should still be able to get some money
    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thought I'd better start a new thread here with regards to my claim against Capital One, already claiming against Nat West and at a pretty advanced stage but better to keep the two issues separate.

 

Sent my S.A.R. on 18th October and received copies back of all my statements last week Went thrugh them with a highlighter and totalled up charges of £626 with regards to Overlimit fees and Late Payment fees. Should be a nice little payout once things progress.

 

Preliminary letter posted on 20th Nov 2006, so the 14 day countdown has started before I send my LBA, hopefully this claim will be a little easier than my NW one, and hopefully a little quicker.

 

I've got quite a bit experience of this site now which should certainly help me with this claim.

 

MBNA are next, but that'll be a nother story!!:)

Well the 14 days passed with no response whatsoever, was a little supprised at this as most other people seemed to have recieved some sort of reply. LBA was sent yesterday along with schedule as a result of this.

 

Today however, the response arrived......this seems to have started in a very similar manner to my NW claim......late in responding. The letter was for apartial offer of £248.....a little short of the £626 requested.

The later stated:-

 

As you're probably aware the Office of Fair Tading, (OFT), are not challenging the right of banks to charge default fees, but merely the level of those fees. I'm afraid we won't give you a full breakdown of our costs to reassure you they're fair as this is confidential business information. We're continuing to work with the OFT at the moment to resolve their issues.

 

Although we feel £20 is a just fee, we have reduced our charges to £12 so we are in line with our competitors. I appreciate that you have incurred previous fees at the higher rate, and would like to address this.

 

I've reviewed your account and, as a matter of of goodwill, I'd like to reduce the fees we've added to £12 each, so I'd like to offer a refund of £248, if you'd like to accept this please sign and return the settlement form enclosed with this letter, I'll action your refund as soon as I receive it.

 

Well for starters they are refusing to let me have a breakdown of their charges....is this allowed?

 

Is this deemed to be a fair offer the difference between old fees and the new reduced ones?

 

I'm not really up to speed with the Credit Card claims as I've been soooo busy sorting out my NW one, do they tend to pay-up the full amount in the end, or should I just accept?

 

Any advice would be much appreciated.

Hi Deller

 

You should accept the offer as part payment only and that you will be pursuing them for the rest. There is a letter in the templates library for the next letter. The banks refuse to give out the real cost to them as it is commercially sensitive information as they say, so you won't get that info.

Send your new letter giving them 14 days before you start action. The LBA and your new letter will have a simular timescale if you post it today.

Well 14 days from LBA are up....well actually I've given them an extra day. I'm ready to file my claim through the courts and will do this through MCOL as it's a little awkward for my to get to the courts.

 

Just want to check a couple of things before firing it off, firstly is this the correct address to use when submitting my claim:-

Secondly, for my POC I assume it's OK to use the same version that I would for making a claim against a bank.

Im really surprise at the way this has turned out for you as Ive completed a few claims aginst Cr*p1 and they all followed the same suit.

 

1. Have you checked you statements - as they usaully just stick the

refund directly onto the card whether you except it or not?

 

2. They usally refund all the charges down to the £12 Oft limited after Prelim - does that fugure equate to your offer?

 

3. Usually get snotty leter refunded the remainder after LBA.

 

4. Did you send your letter recorded? Im not one for giving any bank or CC extra time but my thinking is, its not like them to not repsond so maybe your letter has a - gone astray or b - been held up in xmas post.

 

Itmaybe worth phoning them just to find out if they have received your LBA - I would hate for you to start a claim if they have not received your LBA.

 

However if all of above checks out - then let the games begin!!!!!!

 

The POC that are outlined in thelibraries are perfectally fine Ive just had a quick look at them and cant see why you would have to amend them - its just says account and not bank account, so its all the same thing.

Havn't had statement for a while, but know my balance is zero so could phone to see if there's been any activity on account.

Yes this figure does equate to my offer.

Letter was sent recorded and I've just checked on Royal Mail website where it states it left the Nottingham office on 8/12/06 - no POD available though!! Perhaps I should give them a couple more days - 14 days from delivery will be 22nd???

Sorry dellar - for some reason despite my previous posting this thread did not link to my user CP!

 

It looks like you have your answers now though!

 

With regards to the other poster about excepting part payment - sometime you do not have a choice as they automatically pay it back onto the card!!!! So you are only aware you haev been paid sometime after the letter informing you has been delivered and account has been credited!

Well I've filed my claim with MCOL today, don't see why I should give any time extensions, would they, I think not!!

 

Nice to get that out the way before Xmas, I know nothing will happen for a while yet so I can now sit back, eat, drink and be Merry!!

Just to let you know that THIS bunch are as mad as a box of frogs.

We have had the most amazing experiance with them, sent to DCA then taken back from DCA (although Cap 1 said we were still with the DCA as they were saying "No"!) then off to another DCA and back again, all while we trying to sort out what they owed us AMICABLY :p .

Gave up in the end and filed, claim needs acknowledgement by 28th or thats it,we win :D

Gets on your nerves doesnt it ....

It certainly does get on your nerves, but if you've read my NW thread then you'll know a few minor problems aint enough to put me off!!
