    • I believe it is helpful to seek guidance from a range of places and decide on the validity of the sources and frequency of responses which are most helpful. A single voice can be a dangerous thing. As, of course, can groupthink. Scott, it feels like £4k on a solicitor for a £1.5k bill is overkill. Were we back in time I'd suggest small claims court as your claim sounds like it may be straightforward? By all means add that phrase on. I also suggest you contact the court and go and sit in on a couple of similar cases to get a better understanding before you shell out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Saturday morning all ready to move, when i get a call from letting agent saying landlady has changed the moving in date!

Now we have a piece of paper (the receipt for letting agents fees) saying tenancy to start on 18th November

Can we claim for additional expenses and inconvenience? (we are in now) but the whole thing has been a nightmare!

Sorry - ok. The tenancy had not begun. But the contract was still in force. This means that you can claim for actual financial loss due to the breaching of the contract. Do you have a copy of the contract signed by her stating the original date?

no afraid not, she didnt sign anything all i have is the 18th stated on the receipt for the admin fees i paid the letting agents and thats when the date was set at as far as i was concerned as i have heard nothing to the contrary until saturday last

Thing is, without a signed contract you are going to struggle to get anything done. You can obviously try them, but any court case is almost bound to lose.

Cillit,in reply to your post and in my opinion:

 

1.You DO NOT have any form of redress with the landlady as the contract had not been signed yet - I agree with what Mr.Shed has already mentioned.

 

2.Regarding the letting agent,this signed receipt was for reserving the property for you until the 18th of November rather than the moving in date being the 18th of November which are two totally different issues.

 

By the way Cillit,what are the exact words written on this receipt?Please post them here as this may change my view.

Dont worry its not worth the bother i'm just so fed up with it, the date was given as the 18th as that was the day we were able to move in due to finances, i would've thought the least the agents could've done is to keep in touch with landlady so that we all knew where we stood!

I just feel very let down:cry:

Cheer up and settle in your new property!

 

Also,if you are upset and angry it clouds your thoughts and ideas.

 

When you feel ready,post the wriitten details on the receipt.

 

Remember I do not think is a good idea to have a clash with the letting agent at the start of the tenancy.Also,as time goes by you may find out more which could potentially make your case stronger.All you have to do,is let us know the chain of events.

 

So,what is the rush? Remember you can sue for breach of contract - if we can establish this - 6 years after the event.

 

So,save it for the end of the tenancy and even better after you have moved out!
