This is the account i mention in my first post i think it was but my credit file is saying no But only goes back 72 months?

every other account i had in 2009 when i got in trouble was defaulted and has since been wiped form my credit file.

 

i have spoken to Marbles( before i posted here) and asked the date of default and i would like to raise an official complaint as to when it was or if it was not defaulted why not as it should have been to follow FAC Guidelines.

 

i am awaiting their findings? or do you think i should SAR Marbles anyway just in case the official complain was a fob off

Only advice is to NOT use marker pen to cover up identifiers, it is easily read through.

 

Other than that, sit back and wait. See what they come back with....

Simple, you do nothing, after 12+2 days, you can withhold ALL payment to them.

 

Until they can provide the CCA, and an enforceable one at that, then you pay no-one.

Brilliant stuff i sent these out on 21st February recorded delivery

 

What if they put me down as a late payment on my credit file as they have been because they keep changing the date it is due .

 

i used to pay Payplan on the 12th of every month and they said it was a 30 payment so every few month put me down down as late payment.

also i'd go start a thread in the HFC forum

as details drip in

you need to start a new thread in the named bank forum of the original creditor for EACH DEBT

else this thread will get MIGHT confusing

Well done, you can save yourself a pretty penny by NOT sending everything via RD, stuff like CCA's can always always be sent 2nd class post but obtain ''Proof of posting'' which is FREE from the PO counter, only the important stuff, SAR's or LBA need be sent recorded delivery.

had more generic replies back saying they have sent to OC for the original agreement and this can take 12 weeks ? so i just dont pay until they send a copy for you guys to agree if it needs paying ? that is correct yes?

 

also had this reply back from IDEM servicing who are dealing with Paragon Personal Finance Ltd original creditor Tesco Bank what advice do give me on this one?

Correct, STOP all payments until they produce enforceable agreements.

 

Keep a diary of events now, especially regarding IDEM and their threat of harassment.

Right quick update

 

i sent a SAR to Marbles on the 20th Feb and i have still not heard anything what do i do?

this is the only debt showing on my credit file and is owned by Capquest and it states in big words on my credit file " in a debt management plan "

 

they also ( capquest have not provided a signed agreement for this account so i have stopped payments ... now the thing is i need to apply for a mortgage and my credit score on Experian is excellent 999 so dont want to do anything to effect that?

 

Any ideas on what i need to do to get this entry on my credit file removed?

and as there is no default either?

Yes i understand that but they ( Capquest) report every month to the credit agencies if my payments are on time or not? if i am not paying them( as they cannot provide a signed credit agreement ) this will be detrimental to my score within a couple of months. or should i be asking them to remove the monthly log of payments on my credit file?
