    • I had to call an ambulance for my wife, but one of the paramedics was not happy, about the condition of our house, as it's cluttered. And he  would only see to my wife, on the ambulance itself. After diagnosis they took my wife to hospital. My wife was ill for a few months, and received help from the district nurses. We then got a call from a social worker, who wanted to visit us, and discuss ways to make my wife more comfortable. When I asked for more details, she became vague, but could give us a phone number, if she visited. I politely declined her offer, as I was coping, along with my daughter in caring for my wife. Then a letter arrived from another social worker, saying similar things, to the first. I didn't bother to reply. Another letter has just turned up, from the social services legal department, which doesn't say anything specific, but refers to the other social workers trying to visit us. Coming from a legal department, has badly upset my wife, who's recovery was on going, and she now fears that someone will be coming to the house, to do whatever. Do we have to respond, or take notice of these people. Also we recently had a fire prevention officer come and fit, smoke and heat detectors. He didn't voice any concerns with the conditions at the property. Worried, Paul.
    • By not sticking to the deadline which you set you have lost credibility. Your letter of claim becomes one of hundreds of others which they receive and which they put in the bin because they think that you are just bluffing.  
    • 05.05.24 Ever so sorry if I have entered this in the wrong part of this website.   My grandfather is in his 70's and retired.  He asked me to help him find a work pension that he was paying into when he was working. From 1967 - 1982 he worked for a Fabric Dying Company, Celanese, Spondon Derby UK. I have already used the GOV.uk Trace Pension Scheme. It listed a few pension companies : Akzo Nobel (CPS) Pension Scheme formerly Courtaulds Pension Scheme.  I do not fully understand how this works but I think this scheme is administer by a company called Willis Tower Watson. We have called this company, got through to the pension department submitted all my grandfather's details (D.O.B. , N.I. no. etc.) but that agent tells that they have no record of my grandfather and ask what is the name of the pension scheme. Here is the problem, his home was burgalled in 2005 and a briefcase which contained his legal documents was stolen. So he does not know who was the Pension Scheme company. I have a this phone number 01332 681 210 for Celanese but it just rings and never gets answered. So I am asking for help if anyone can tell us where we can try next. I am also hoping for a massive long shot that one of them members on this website, worked for or knows someone who worked for British Celanese Spondon Derby and could tell us of any pension company. Thanks for any help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I also started my claim in March and have been issued judgement by default. I am going to enforce this on Monday at my local county court but judging by the mess around you have had I realise that Abbey wont be paying me in the near future! Your thread has been really helpful in preparing me for what will be a long process. Thanks and good luck with your case

Christine just phoned me. No cheque yet but practically begging me not to deliver my bundle to the court. I phoned the court to get their advice and they have received a letter from Abbey informing them of their intention to settle.

 

Therefore I do not need to hand in my documents.....or do I?:confused:

 

Can Abbey back down at this stage and not settle?

They seem to be making offers but not paying up. Keep going until you have that cheque in your hand.

Not heard from Miss Smarmy today. She most probably fainted when she saw that i had handed in my court bundle, signed an affidavit to say i didnt receive shABBEYs disclosure. I sent it to her special delivery so she should have a copy in her possession today LOL.

In septembers plublications issue no 56.

Walter Merricks chief financial ombudsman had this to say.

 

We are accused – at one and the same time – of being above the law and unchallengeable; engaged in a disgraceful denial of human rights that a landmark test case will bring to a halt; suffering a stunning blow in the courts that will save the financial services industry millions of pounds; and outrageously allowing firms wrongly to escape paying millions to consumers with financial complaints.

However, these kinds of dramatic yet rather confusing claims are – hardly surprisingly – unlikely in reality to rock the foundations of the ombudsman service. No public organisation involved in the contentious business of handling disputes is immune from people wanting to test the limits of its remit, particularly as there are always commercial interests at stake.

 

this to me isnt a man worth complaining to about a bank or any other financial institution.

do you really think that the ICO are on our side? are they not a public institution too?

the ICO seem to be taking a long time reporting on shabbey, and it seems to me that they will come out with a report that defends shabbeys complaints procedures.

All of this will only push us to group together and take a conglomorate case to court rather than on our own.

Great news NN! :)

Abbey - 547.00 settled in full.

Second claim: £204 WON.

Barclaycard - 142.88 incl interest due WON BY DEFAULT as they didn't even bother entering a defence. Barclaycard paid up £184.88.

 

MBNA - Concluded £634.31

Kinda disappointed I've no more banks to go after now...

Congratulations NN, I just read your whole thread. Can't believe how long it took. (I mean to pay you, not the thread!)

Settled at 50%

Clydesdale £155. Should have been £310 charges, plus interest :( Husbands Account.
