  1. Hi Im in the same boat as everyone else with the Northern Rock Together mortgage in Nov 06. Loan was on 7.54% interest rate. I now live overseas and would love to sell but in negitave equity. Also now mortagge has been passed to NRAM (new side of NR when it was bought over) Mortgage was £80,000 Unsecured Loan £30,000 House Value £80,000 so in negative equity If you have any info that may help it would be appreciated.

I am 60years old, live in scotland and get ESA benefit paid every 2 weeks as I have heath problems and had to sell my house last year due to family problems, there was a small profit from this but was paid out to clear debts I owed as i had to borrow money to pay years off back council tax about £16000 plus house was in bad repair and needed work done before it was sold. I moved into my daughters flat as she is living overseas and instead of renting this out allowed me to stay there as we thought I would get some benefits to cover the costs. She gave me a tenancy lease and have been fighting with council for a year now as they say I had profit when I sold the house therefore am not entitled to any council tax rebate or housing benefits. I have taken all the proof of where payments went from the house sale mainly to pay off coucnil tax plus bank statements showing I have no money. Council refused me so I put in an appeal to the appeal board and, we got letter from the appeal board, saying they have returned it to council for them to reassess again, the council have now still refused. My daughter will have to sell the flat soon if I can’t get this matter resolved and also the council claim that I must pay full council tax even though I live there on her own and on benefit so cannot afford full coucnil tax. They are now asking for a year of owed money or passing this to debt collector. Any advice is appreciated on how to proceed as I get nowhere with the council and will soon be homeless.
  4. I've been fighting abbey since Feb for a settlement and had to file at court in the end. I've got a court date of 19th Sep 07 however, i've now had a letter from Abbey saying they will be requesting the courts stay my claim pending the outcome of the test case. Is there anyway for me to counter this by writing to the court and suggesting that the stay shouldn't be granted and does anyone have a template lettter?????

  6. Does anyone have the tempalate letters for CCA request? I sent a CCA request for my brother and have had no response and the 12 dyas have passed, should i issue another 30 day notice?
  7. Matt I have claimed from Halifax and got an offer from NR at the weekend and they are tough. My friend whom i had helped has also now been offered 50% of his claim from HBOS but am holding out for full settlement. Try your luck as you have nothing to lose if its under £5000 as it will be appointed to small claims court. Good Luck

An update on my case, i sent of the following letter last week "Without Prejudice save as to Costs Dear miss Caldwell ACCOUNT NUMBER: xxxxxxx RE: Court Claim no - xxxxxx I am writing to give you a final opportunity to settle my claim without the time and costs of the courts. Our hearing is approaching and as your request for a telephone hearing was denied, I am willing to cancel should you offer full settlement to save yourselves further costs. I look forward to your response" I got a response on saturday offering me a settlement and don't understand their reasons but i am taking it as my claim was only for £1000 and that included application fee/exit fee and i was chancing my luck asking for application fees back. The letter reads.. " .... At this stage, Northern rock plc is yet to receive a properly particularised claim, let alone a compelling line of legal reasoning that might persuade it to settle this matter and vacate the hearing listed for 23 May 2007. However, it estimates that Northern Rock Plc's legal costs for making the application will be in the region of £400. Given the above, for reasons of commercial expediency and without the admission of liablity whatsoever in relation to your claim, Northern Rock plc is therfore willing to offer a settlement comprising of the estimated costs of teh hearing to be incurred, totalling £400, and £285 which Northern Rock agreeed to refund to you as set ouyt in its defence. Kindly confirm by return if you are minded to accept this offer of settlememnt and Northgern Rock will forward a cheque to you for £685...."

  10. I'm about to start a claim for my mum agianst an old barclaycard, only problem is it was passed to C.S.L to collect and she has been liasing with them. I was going to ask them to supply the original agreement as well as a breakdown of charges but Should i send my letters to Barclays or to CSL.
  11. Good news... I've got an email from DL piper offing full settlemet on my ERC charges. They have notified the courts that they will settle befor ethe 11th May (our court date) so am just waiting on the cheque.
  12. As i recall the service address is for people who want any correspondance to go to a different address from their home address and the reference is just your own reference that will be put onto any letters etc. I would just use your name or account number as the reference.
  13. you need to find your proof of posting very quickly, if you do i wouldn't worry as you can then follow the procedure, however if you can't try emailing them for a eta on statements, I did this and they replied. If they don't have your letter you will need to get another one of very quickly. I found that the halifax were one of the best banks to deal with when i was claiming.

I had a similar problem with capital one, the balance was made up of mostly charges so i refused to pay and pursued them to remove the charges by following the claiming procedure, they offered me 50% at first then 75% but once i filed at court they offered full settlement. Do you know how much off your balance is made up of charges? If not call and ask them and if its less than £1500 then you have a good deal but if its more i would pursue them to refund all the charges. Good Luck..
  15. I don't think they would cancel your mortgage, i had a two mortgages and claimed back my bank charges successfully. Your mortgage accounty is separate from your bank account. I do know of some people who had to open a parachute bank account before they started there claim. I have managed to get back all my bank charges and mortgages charges, am claiming ERC now.
  16. My calim was for £2200 but they have repaid me £800 for the charges and only owe me £1400 for ERC and exit fees. If i don't have to pay their fees then i will go ahead with my case unless they offer to settle. I will scan the letter i received and post it.

Zoot I am claiming charges, ERC,completion fee and exit fee, my claim is for a total of about £2000. i refused the request for their part 18 and they wrote to the courts asking for it to be struck off but the judge has refused since they have now sent me a court date. I sent the following letter to the judge: "Please find enclosed copies of all my letters to the defendant. I have responded to all the defendants’ letters to date, and I would like to complain about the offhand manner in which these supposedly professionals are behaving towards a lay individual, and respectfully suggest that they are using stalling tactics claiming not to have particulars of the claim. As you are aware, there are several thousand cases now coming against banks and I am aware of hundreds of people who are currently claiming against this Defendant and I am in contact with others who have received the exact same letters from the defendant. I feel that I am enough of a disadvantage as it is, one non-legally trained person against the might of a huge financial corporation with a vast legal department, and am both shocked and disgusted at the contempt with which they treat me and the Court’s Directions. Respectfully yours,"

Hi, I've been following your thread and others agianst NR, i'm ahead in that the filled acknowledged my claim and tried to get a part 18 request then my claim struck out as i refuses, however today i received a letter from the courts given me a hearing date of 23rd May and also refusing NR request for telephone conference. I'm now thinking about cancelling my case due to all the recent news but also think i may have a case as the judge has already sided in my favour.....
  19. I'm worried now, I just got a letter from DLA Piper who halifax have now appointed and they ask me to drop my claim based on recent claimants who have been unsuccessful. They say if i cancel my court date with seven days they will not claim fees against me. They have also send me print outs of the lastest news from the Mods of this site advicing people to not start new claims.   21. I've been away and just logged on to read the bad news and very confussed on what to do next??? The good news is that i got a hearing date of 23 may and the judge ordered that: "1. Matter to be listed for a hearing with a time estimate of 1 hour 2. Application for a telephone conference is refused." However, i'm a bit worried abot going ahead now after reading the other threads.
  22. I've been away and just logged on to read the bad news and very confussed on what to do next??? I've got two claims for ERC and exit fees - one with northern rock and the other with halifax. I received a hearing date today against northern rock and the judge refused their application for a telephone conference on the other habd, i received a letter from halifax solictors asking me to drop the case and no fees will be claimed they also attached extracts from this website showing the news above. Not show what to do now?
