      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I can't believe it - the court office closed at 4pm!!!

 

Now I have to wait until tomorrow to find out what happened.

 

The good news is I was late coming back to the site because I had a phone call about my Bank of Scotland Mastercard and they are going to pay up AND allow reduced payments on the remaining balance AND they will not charge any more interest!!!! RESULT - but not the one I was expecting!!!

I E-mailed DLA Piper and this is the reply I received. I wonder if it got to the court in time????

Well, DLA filed the application at Northampton court when they should have done it at Darlington. They only filed it yesterday and it has been accepted!!!! :-x :-x

I spoke to a lady from Darlington court and they now have to wait for the documentation to arrive from Northampton. Once it arrives the judge will look at it again (but only on a Monday or Wednesday) and could do one of 3 things:

1. Grant the set aside (which I asked him to do in July).

2. Schedule a full hearing (Same as Whizzkid and NeilP).

3. Throw the whole thing out.

 

Number one would mean a date being set for a full hearing of me v Abbey in court so IMO this is the best outcome I can hope for.

Number two just drags things on longer and number three is unthinkable so I am not even going to consider it.

 

Too many chickens counted yesterday.:(

 

Meanwhile I am going to E-mail trainee solicitor and ask why it was filed in Northampton.

Yes I did file on moneyclaim but everything was moved to my local court when DLA applied originally for the set aside. They hold the file now and the lady from the court was surprised they had filed in Northampton.

 

I have just E-mailed Jodie the trainee and told her the delaying tactics will not put me off. This application could have beeen made as early as 2nd August but as we all know they leave everything as long as possible to drag things out.

I've been doing a lot of thinking and this has only just occurred to me.

 

When I wrote to the judge in July I told him I agreed to the set-aside but his response was to insist that Abbey/DLA make a full application. They did this on Wednesday.

 

Now, did he do this to have a look at their argument in light of the information I provided in my letter (Whizzkid and NeilP being the main cases), and is he therefore thinking about NOT allowing the set-aside? Otherwise, why insist on a full application for a full set-aside hearing when I have already told him I agree to the set-aside?

Bloomin heck - have just spent the last 30 mins reading this thread from start to finish and felt like my heart was going to BURST with all the excitement!!!!!!!! Every time i went on to the next reply i kept thinking 'THIS IS GOING TO BE THE ONE WHERE YOU TELL US YOU HAVE WON' I Think you deserve to get every penny back and you should also ask if you can be a site helper/moderater. The judge is looking at the application made by Abbey today. I have been advised to phone back after 4pm or in the morning.

I already had that bit from Alan, on your thread bookmarked and I've copied it nearly word for word.

 

I have also E-mailed my trainee solicitor (who incidentally called me 'he' all the way through the written defence!!!), and informed her that the AQ will be at the court tomorrow unless they settle. I told her what I'd put on the form so she will hopefully be aware that it's similar to yours, and others, and that WE KNOW WHAT WE ARE DOING and will not back down.
