    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, we have a car loan with a company and in the last 12 months we've received two email both containing a lot of attached letters that contain personal information on a significant number of people. They contain name, address, bank details, car reg details and so on. I'm a bit concerned about this as I worry that our details have gone flying around to others! I also feel sorry for the people whose details I'm seeing!

I've alerted the company each time and just received an email back saying "sorry about that, just delete", very offhand about this!

Is there anything else I should be doing? I'm concerned that I've received this info but more so that they're doing this and not bothered about it.

I would not bother to alert the companies involved. They will simply want to cover-up.

 

I would do three things:

 

I would contact the people whose details have been passed to you and inform them. If you wish, send them to this thread as well.

I would complain to the information Commissioner's office, giving full details.

I would talk to the media. I can put you in contact with the media if you be prepared to discuss this with the journalist. This kind of thing needs the harsh light publicity about it otherwise these companies don't do anything at all.

Definitely need to be shown the error of their ways by highlighting it with the media and the ICO.

 

This is clearly not a one off, if they are doing it with others personal data, you can bet your bottom dollar that they have leaked your details to another third party.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I've received medical reports meant to be sent to solicitors (and instructions from solicitors to medical experts), at least 3 times now (2 one way and one the other), due to having an email address a bit similar to a well-known expert.

 

The first 2 cases (all 3 were different people at different firms) the issue was taken seriously when I notified them.

The last time I got a "ohh, well, these things happen and it's not a big deal" type response.

 

I suggested they let one of their partners know that I'd called, the error I'd reported, and of their response.

Additionally, that as a result of their response I'd have a hot drink, since I needed one before:

a) calling the injured patient on the mobile number listed in the paperwork to tell them I'd had their confidential medical records sent to me, and details of the accident and what they were suing for

b) letting the SRA know they'd breached confidentiality AND been blasé about it when the problem had been notified to them

c) letting the ICO know,

d) letting the medical expert who it was supposed to have been sent to know, so they weren't later able to be blamed for "not replying" to an email that had never been sent to them.

 

Unsurprisingly, one of their compliance / governance risk managers called me back before the kettle had reached boiling ......
