    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

this will take some explaining but with try my best!

My granddaughter ( aged 2 and a half ) decided she would play with the mouse on my pc while my back was turned, no idea what she has done but I now have a screen that has a big margin at the bottom!

This means I can now see my desktop picture where before I could see the whole page, hope this makes sense!

I have tried everything to get it how it was but can not find how to get it back, The zoom is 100% so that is fine, just at a loss to what to do, I did restart the pc in the hope it would rectify itself but nope!

It is a bit hard I guess to explain this, and not really sure if can do a screen shot?

I am not very PC Savy lol

Thanks

Sandy xx

Try to double click on the header bar of anything you open which only comes up half a page big. Or in the right top hand corner of anything you open is a minimise/maximise icon..

I think your grandaughter left clicked on the mouse button which brings up a list of settings and saved default size of window that opens up.

Difficult to explain without seeing. But i suspect anyone under 40 would fix t for you in a few minutes.

We could do with some help from you.

This may sound odd but at the bottom of the screen, is it your tool bar that is covering half the screen?

Right click on your desktop (not in browser)....Personalize...then click Display (bottom left).

Your browser setting size (which is separate to display settings) is at the top right of the screen (3 vertical dots)

It could be that. The bottom tool bar has been changed, forcing windows opened to resize themselves.

Try hovering your mouse pointer on the top edge of the tool bar and see if you can drag the tool bar down. An up/down arrow should appear

When you open up other programmes do you have the same problem ?

I have seen this problem before and can't remember how i fixed it. It must be something to do with windows settings that have been adjusted and saved. Possibly screen resolutuon ?

Uncle, the problem seems to be on every page I open, even on my desktop, I have what can be described as a ridge along the bottom, meaning I can see the page till about 2/3 inches from the bottom

The only other option I can think of is to restore your PC to a date previous to the childware!

Is it the task bar that is showing as a couple of inches as it sounds from what you've said. If so, right click on task bar, then see whether it says lock the task bar, if it does, untick it. then hover the mouse over the top of the task bar, until the cursor changes to an arrow, then just drag it to the right place.

In England advise is a verb (a doing word) advise/advising/advised, advice is a noun. I might ask for advice or give advice.

The same with license (verb) license/licensing/licensed, but one would have a driving licence (noun).

So every window only opens up covering half of the screen area, with a gap at the bottom, where you can see the desktop ?

And using the maximise screen icon at top corner of window does not make it go full screen ?

Hi

When you Right Click on your Desktop (not your browser) what is displayed in win 8? (does it say anything like screen resolution?) if it does click screen resolution from the drop down list and see if you can adjust it that way.
