Help I'm moving house and need to go to court

Can anyone help?

 

I will be moving house in a week or so. I thought the banks would have paid up by now but a couple have not so I need to start court proceedings.

 

How long can I have between receiving their letter saying they won't pay and going to court?

 

If there is a time limit and I go over it do I need to start again?

 

Would sending the banks a letter informing them that I am moving address but after I have moved I will start court preceedings be a good idea?

 

Aaaargh! I suppose a bit of bad timing on my part should have waited till after I have moved.

How long can I have between receiving their letter saying they won't pay and going to court? you do not have to start court action until you're ready but bear in mind the 6 year limitation rule.

 

If there is a time limit and I go over it do I need to start again? NO but if its been a really long time, I'd say more than 5-6 weeks then I'd fire off a letter stating your intention to start proceedings within 7 days.

Get a mail re-direction from your old address when you move and after you've moved inform the bank of your new address. There will be nothing to stop you from starting court proceedings now at the court which will be your new local court. If the move is cancelled you could then apply for it to be transferred to your current local court.

I'm in a similar position to rscott1979 other than that I've started court proceedings and i'm not only moving house at the end of december but also goingt to france for 4 months. I'm completely unsure of what to do? can i just get my mail redirected to someone i know and some how leave them in charge of my case (Even to go to court if necesarry) and if so how do I inform the court of this?

 

Any help would be greatly appreciated

hi jakester, I'd say wait until nearer the time to decide what to do - your case may even be settled before you move. When it gets to about 3 weeks before your move, if it looks unlikely to be sorted out give the court a ring and see what they advise you to do. I think you would have to pay for someone to represent you if needs be, as I don't think a lay-representative can attend court without you being there aswell. I'm not 100% certain of this though, and you might be better off asking the court to hear the case in your absence based on written evidence you have submitted. wait until nearer the time to decide what would suit your circumstances best.

That's eased my worries a fair bit, i'll give the court a ring when I've found out if the bank are going to defend and sort it out then, lets just hope I don't have to return from france to attend court!

I'm moving about 50 miles away. I've not diverted my post as where i live now someone who I know and trust will forward any mail onto me. I have not started the court process and will leave it till after I have moved. Before I had read the reply to my first message I had phone the Court Customer Services on 02071892000. I had a few questions...

 

1/ do i pay fees up front? Answer - Yes I do

2/ If I win what will I receive? Answer - my money I am claiming plus the court fee

3/ If I loose what do I have to pay? Answer - Minimal payments

4/ HOw long can I wait before I start court proceedings? Answer - 6 years from the first date of money owed.

 

Thank you all for your help and I hope this helps other people.
