It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone,

 

I have been having a read on the site with regards to payday loan/short term loans.

 

I have had several of these and being completely honest I dont know where to turn with them all. I have tried to pay them but am getting no where.

 

Probably best if I start from the beginning.

 

 

A few years ago I was taking out loans left, right and centre and spending the money on stupid things - electronics/cars.

Looking at my credit file there is a few of them all round about the same time.

There was a lot of things escalating in my life.

 

 

I have now got my life back on track and was diagnosed with BPD.

My triggers for BPD are money, electronics & cars.

 

I have defaulted on all the loans and have seen people are now getting these written off due to unfair lending.

At the time of the loans I was self employed and have lost the business due to my illness and not being able to keep the business a float.

 

So I was looking to see if anyone can give me some help/info on whether I have a case for this or if I am up the creek without a paddle.

 

I have my credit file from noddle so will supply all the details I can from them.

Sorry If I have put a lot of information.

Just wanted to cover as much as I can.

 

 

As you can probably tell I took out a lot.

With my BPD it seems as though this is a normal thing what I did but speaking with my consultant

this is a regular occurance with people who have my condition.

I have it under control now but want to get this all sorted as it stresses me out thinking about this all.

 

I did contact a few companies last year to try and sort this and had a payment plan with them

but I have been unable to keep up with the payment dues to my finances.

 

If any of you could give me some advice on whether I have a case that would be greatly appreciated.

looks to me like you have a very good case for irresponsible lending with all of them.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Report back where possible with any info you can provide and contact each lender for a statement summary of all loans etc...

 

Dont accept spreadsheets, its needs to be an official document.

Hi Thank you for getting in contact . It was with Provident direct. They came to my home.

 

For the summaries of the accounts can I do that via email direct to the companies? Also in the summary should I request when the loan was taken, the amount , missed payments and whether they credit checked me. Is that all I need to ask for?

Peachy work quick , I have the loan summaries from them already.

Anyway SAR might be a good idea as you can get a lot of info out of Peter Crook and Provident.

 

Think they may be going to try playing hard ball with me.

 

Any chance you could have a look at the peachy docs and what I should do now :)

How close together were those Peachy Loans?

 

Going by the email from them it says "Please note that you took the first loan out with Peachy on 12/12/2012 and you extended the loan on 10/01/2013 and paid the extension fee in the amount of £63.00. The loan was then deferred. You requested the second and final extension on 08/02/2013 and as such paid the extension fee in the amount of £63.00. Then the loan you have with Peachy went overdue"

 

I think going by the paper work I only had one loan with them for £200which I rolled over twice , I have paid them £436 to date but they say I still owe £291.80

Okay Rolled Over twice which is now not allowed. And its gone above the 100% marker that you borrowed with Fees and charges, I would think that is disproportionate and could be counted as Unaffordable lending. They should have put a stop to charges and Interest by that point.

Have just received myjay summary. They have put in the email a statement if you require it I can post this aswell. It basically states that they had no need to credit check me due to the size of the loan, they went on the information I had supplied to them

 

Thats BS... All Loans should have been subject to Affordability checks and also Credit Checks... MYJAR should have been doing these from Day 1... But havent.

Thats another reason for complaints. I also see they gave you £600 in a very short space of time as well as allowed th £300 to go above the 100% borrowed marker. Inclusive of unrealistic fees / admin fees

Thats what I thought , What would you recommend from here? Would it be best to wait until I hear from all of them ? Or to make a complaint to the current companies who have replied. Also going by the current information the loans were at the same time aswell, will that make a difference.

 

Btw forgot to say earlier I found 2 other payday lenders in my email which are not showing on my credit reports. Vivus and Bongo loans. They were at the exact same time as all the others aswell. Cant believe I had so many at one time.

Get Summaries for everything... So Bongo and Vivus... Get Summaries. And we can advise.

 

Great I have emailed them earlier. Hopefully they all reply as quickly as the ones who have already done so.

Thanks for your email. I can confirm that you have only ever had one loan with PiggyBank. You took this loan on 10/02/2013 for £265 for a period of 31 days. Unfortunately your repayment failed and you did not contact PiggyBank until Marc 2015. In this time your balance had increased as detailed in your legally binding Loan Agreement. To date you have paid £160.00 however you have an outstanding balance of £593.11 and you have not made any of your agreed repayments of £10 a week for over three months now.

 

 

A full credit and affordability check was done upon your details when you applied for a loan with PiggyBank. Your account has now been passed to our Debt Recovery team who may look to take legal action to reclaim the money owed unless we can resolve this.

 

 

I am happy to look at an affordable repayment plan you just need to let me know how much you can afford on a regular basis so that I can look into this further for you.
