    • An update - Still receiving emails and letters - but have been getting text messages too. nothing aggressive just asking me to get in touch.    the text makes it look like it from the bank on first glance - it reads -   'the banks name' would like to dicuss our recent communication...etc... then lists IDR phone number and email FYI - reporting them as spam
    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

    • ah this is a B2B PCP then as your are sending the SAR as a private individual and not as repping the co. you need to prove to them. unfortunately, i think that will also reset the 30 days. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Maybe you can explain Caro how the informative/authoritative system works.

 

It seems the more blobs the giver has, the higher rep/points the person receiving receives. That has answered a lot of questions if my understanding is correct.

I don't ever recall there being scales - it has always been a star.

 

There were deffo scales, I remember people having in their sig's...If I've been helpful please click my scales, I've a feeling some still have :)

Yes you're right Caro, the link was highly informative, especially Honeybee's explanation. Just to repeat my reply post 54, the more green blobs the giver has the higher the rep the receiver gets.

 

Now back to a new hobby, I've been looking at this wild swimming. Not that brave with cold water so I would wear a wet suit.

Not after you have peed in it !

 

Problem with a dry suit on a long swim is that you will want to pee and it will be too late by the time you have got the suit off. They are more tight fitting than a wet suit from what I remember.

We could do with some help from you.

I can give and receive rep but I see little merit in the system if blobs prefer not to have it on. I've been in cag forever but wouldn't say I'm an authority but it's nice when people thank me for whatever reason so am almost sure to have lots of blobs. Then again there are those who give rep for no other reason than to get someone to do the same to them so they get more blobs, but it doesn't make them any more knowledgeable and makes a farce of it. I therefore disabled it. I believe that if I give rep it still adds to others points but I may be wrong. Tbh I never gave it any thought.

CD I've noticed urs have multiplied:-D It's like buses

 

I'll stick to swimming at the gym in a heated pool, and no shopping trolleys, bugs or pollution caused by who knows what thanks!

genuine q - which wld be worse, a river as such, or a public pool with human poo/wee, snot, etc subject to chlorine?

Pool with chlorine better every time! Did you see how ill David Walliams was when he swam the Thames? The pool I go to Is quite small so doesn't get lots of peeps in it.
