no they cant as far as I know.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Also can someone just clarify one thing for me,

I do have 1 CCJ which was issued in january 2013,

the creditor tried numerous ways of getting payment without success

eg attachment of earnings (i am self employed)

property charge (i rent)

even a warrant seeking possessions (i have nothing of value)

they rejected my offer of £1 a month,

in the end i was ordered to pay £10 per month, which i did for a while,

then i lost creditors payment details,

requested new ones,

never got a reply,

since then have not paid the £10 a month.

I am assuming this SD, APS are trying to deliver is regarding this debt,

but am i right in thinking that as the creditor already have a CCJ against me

they don't even have to serve SD papers,

they can just petition for bankruptcy :/

Confused.

If they have an unpaid CCJ, the could apply for bankuptcy serving the petition, but in your case it is likely to be a court order requiring you to attend the court to be questioned on your financial situation.

We could do with some help from you.

  • 2 months later...

I've just started getting cards from these people again.

They originally started a couple of years ago when I was working abroad

when, I called them via Skype and they stopped.

Last week I got a card, called (141) over 20 times and left a message.

Missed the guy by 20 mins this eve and called them.

I told them I'm not expecting any deliveries and I'm out every evening.

I also mentioned that I'm not happy having someone hassling my Grandad, who is 80 and has the early stages of dementia.

He said he would make a note of what I've said but doesn't know what is waiting to be delivered.

I also had someone contact my (also elderly) neighbour to find out if I live at my address.

Are they allowed to be this underhand and sneaky?

Can I do anything about them bothering my grandad?
