    • Morning dx and thank you for your message.   With regards to your comment about them not needing to produce the deed, the additional directions ordered by the judge included 'a copy of any assignment o the debt or agreement relied upon'  so that is why I thought that point was relevant?
    • Sorry for the long post but I don't want to miss out any relevant information: My wife bought a car from Trade Centre UK and have been having nothing but trouble with it. Unfortunately we paid of the finance used to buy the car as we weren't expecting this much trouble with the car as we we though we would have protection as buying from a dealer. We are wondering if we can still reject the vehicle since the finance plan has been paid off. Timeline is as follows: 13/12/2023 -15/12/2023 Bought car from Trade Centre UK for £10548 £2000 deposit paid on credit card on 13/12/2023 £8548 on finance from Moneybarn (arranged through Trade Centre UK). picked up car on 15/12/2023 Also bought lifetime warranty for £50/month 25/12/2023 Engine Management Light comes on. The AA called out and diagnosed the following error codes: P0133 - Lambda sensor (bank 1, sensor 1) Oxygen Sensor. Error Message : Slow reaction. Error sporadic P0135 - Lambda sensor heat. circ.(bank1,sensor1) Oxygen Sensor. Error Message : Component defective Due to it being Christmas took a few days to get through to them but they booked me in for 28/12/2023 to run their own diagnostics. 28/12/2023 Took car in to Trade Centre so could check the car – They agreed it was the Oxygen Sensor and Booked me in for repair on 30/01/2024. I was told they had no earlier slots, and I would be fine to carry on driving car when I said I was afraid of problem worse. During diagnosing the problem, they reset the Engine Management Light. During drive home light comes back on. 29/12/2023 - 29/01/2024 I carry on driving the car but closer to the date, engine goes to reduced power every now and again – not being a mechanic I presumed that this was due to above fault. 20/01/2024 Not expecting any more problems paid off the finance on the car using personal loan from bank with lower interest rate. 30/01/2024 Trade Centre replace to O2 sensor (They also take it on a roughly 60mile road trip which seems a bit excessive to me – I can’t prove this as something prompted me take a picture of milage when I handed car in but I forgot take one on collection – only remembered next day.) 06/02/2024 Engine goes in reduced power mode again and engine management light comes on – Thinking the Trade centre’s 28 day warranty period was over I booked the car the into local garage for the next day to get problem fixed under the lifetime warranty package. Fault seems to clear after engine was switched off. 07/02/2024 In the Morning, I take it to local garage who say as the light gone off – the warranty company is unlikely to cover the cost of the repair or diagnostics and recommend I contact them when the light comes back on. In the evening the light comes back on and luckily I manage to get it back to the garage just before it shuts for the day. 08/02/2024 The Garage sends me a diagnostics video showing a lot error codes been picked up by their diagnostics machine including codes for Oxygen sensor and Nox Sensors, Accelerator pedal and several more. Video also shows EGR Hose not connected to the intake manifold properly, they believed this was confusing the onboard system as it is unlikely this many sensors would trigger at same the time but they couldn’t be certain until they repaired the hose. 13/02/2024 Finally get the car back as it took a while to get approval and payment for the repairs from the Warranty company. Garage told me to keep an eye the car as errors had cleared with the hose but couldn’t 100% certain that’s what caused the problem. 06/03/2024 Engine management light comes on again. Fed up I go into Trade Centre as I was just around the corner when it happened and asked them how to reject the car or have the problem fixed. They insist that as it’s over 28 days I need to get the car fixed under the warranty package I purchased and they could no longer fix the car as it was over 28 days. When I tried telling them it appeared to be the same or related problem they said they couldn’t help as I hadn’t contacted them earlier. I asked them if they were willing to connect the car to the diagnostics machine and tell me what the problem was, as a goodwill gesture, which he agreed to do and took the car to the back He came back around 30 minutes later and said they took a look at the sensor they replaced previously and there was nothing wrong with it and engine management light went off when they removed the sensor to check it. When I asked what the error code he couldn’t give me an exact fault but the said it one of the problems I told him earlier (Accelerator pedal). I have this visit audio recorded on my phone – I informed the reps I was recording several times. As the light wasn’t on, local garage couldn’t book me for a repair under warranty. 07/03/2024 Light came on so managed to book back into local garage for the 12/03/2024 Whilst waiting to take car into garage, I borrowed a OBD sensor and scanned for errors on the car. This showed the following errors: P11BE – Manufacturer specific code (Google showed this to be NOX sensor) P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow 12/03/2024 Took car to local garage and the confirmed the above errors. This leads me to believe that either Trade Centre UK reps lied and just reset the light or just didn’t check properly (Obviously I am unable to prove this) 22/03/2024 Finally got the car back as according to garage, the warranty company took a long to time to pay for the repairs 28/04/2024 Engine management Light has come back on. Using the borrowed OBD scanner I am getting the following codes: P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow P2138 - Accelerator Position Sensors (G79) / (G185): Implausible Correlation I have not yet booked into a garage as I wanted to see what my rights are in terms of rejecting the car as to me the faults seem related. I can’t keep using taxi or train to get to work every time the car goes into the garage as it is getting very expensive. Am I right in thinking that they have used up their chance to repair when they conducted the repair end of January or when they refused to repair it in February ? If I am still able to reject the vehicle could you point to any sample letters or emails I can use. Thankyou for your advice on my next steps.
    • Ok noted about the screenshot uploads. In terms of screwing up I had one previous ticket that defaulted and ended up in a CCJ from Southend airport because for some reason during COVID I didn't receive their claim form just a notice of default. This hospital ticket was the 2nd ticket that went to CCJ due to a lack of knowledge of the process. Maybe it's easier just to pay them in future I'm thinking though, I don't get them very often anyway

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wonder if anyone can give me some advice over my husbands employment issue. He has just raised a grievance regarding his boss, and his constant threats and bully boy tactics. He has had an interview and then recieves news that his complaint was not upheld. The investigation wasn't handled well at all. No witness were spoken to so it is just one word against another. Details were missed from the Minutes so basically his complaint read as if he was just winging about work. This isn't the case, sometimes He can't keep up due to his disability and has issues with doing overtime our son is severly disabled and He need to be home when he's home from school simple as that ( you'd think). I am writing an appeal out at the moment but have since found out that the boss and 'investigator' used to work together and were heard laughing and joking in his interview! (A little different to hubbys where He had to leave the room and get his head together when explaining that our son thinks it's his fault Hes in trouble)!! After having no contact from the boss ( been off sick for 2/3 months now), he has contacted me all of a sudden and looks to be handling things maybe as he should of done all along. ( this won't last). My question after all that is this, We can appeal the decision but what concerns me is it's fairly obvious this investigator has warned his boss to tread carefully so it don't really matter who does the investigation, he has been prepped by this bloke and will do things right for as long as he has to then start again when everything goes his way. Surely this isn't a fair process?

Right ok

 

First off, get a copy of all the minutes taken. Make the request in wiritng, get them to agree to send them within 14 days.

 

As part of the appeal you want to make sure you express why you feel the investigation was not conducted fairly.

 

Mention that you do not feel witnesses were asked and therefore procedure was not followed

 

You should have access to the grievance procedure that will tell you how to proceed. Normally there are time limits but the sickness may help there.

 

This looks like a complex case that we do not have all the information to.

 

EG Length of service with the employer

Nature of the bullying.

What Proof could be provided

When grievance was lodged?

When was the hearing?

When was the Outcome notified?

Were any reasons given for the outcome?

Your Sickness - Is it related

The Minutes - Did your OH Read and sign them?

WHAT WAS THE DATE OF THE LAST INCIDENT BEING COMPLAINED ABOUT. **IMPORTANT** A tribunal application must be received by the tribunal 3 months LESS one DAY from the last incident being complained about.

 

You may need to move fast to lodge a Et1 and pay the fee to protect his rights to go to a tribunal. (As it looks like a single equality act complaint length of service is not applicable) You will need some expert help with this. CAB? Union? You can lodge a complaint then ask it to be put on hold while internal procedures are carried out.

 

This is the difficult bit, you need to somehow be able to step outside the situation and stick to the facts and then say at the end how it has impacted on your husband. The reason they are prob changing tack is that your OH is off sick long term following what may have turned out to be a Serious Disability Discrimination case at tribunal.

 

Also some words of advice for your husband when it comes to meetings. It seems some may have been learned after the first one.

 

1) Always take a union rep (JOIN ONE if your not in a union) If you have not union rep then he has the right to have a witness.

2) Never Lie

3) Be honest with your rep and make sure they understand your situation aims and goals etc.

4) Minutes - READ THEM CAREFULLY - Ask for inaccuracies to be corrected. Ask for omissions (Important ones) to be included.

If you are not happy to sign the minutes due to inaccuracy write " Signed under duress -- Minutes not accurate" Sign under the last sentence so nothing can be added. OR cross out the empty space at the end of the page.

5) Make sure in the meeting you get it noted down you want a copy and arrange when you are to receive it.

6) If your OH needs time to answer a question he can request an adjournment to talk to his witness or rep. if the adjournment is refused make sure it gets noted down.

 

Emazzi is pretty hot on employment stuff and more upto date than me so id await her input. Also once you answer allt he questions above u could flag your post. Im worried abotu time limits here.

Hi bit of an update. We have now sent the appeal in, and have another worry. My husband was suspended for 'all edged gross misconduct'for 48 hours when he went off with stress (. Can't remember if I put in post). Last week he went for a getting back to work meeting and was told by another manager that he was no longer suspended. It was informal without minutes but as suggested he did take his own notes. They also mention a holiday we had saying that his holiday will be deducted since he is off sick. The following day they received the appeal. 2 days after He gets a letter to say that he IS still suspended! This seems fishy and I mention the holiday as I'm hoping it's been deducted already. Surely this would prove the conversation in the meeting that I'm currently off sick not off because of suspension. He was also at the meeting offered an alternative job, which just supports what I thought which is they were. Just trying to get rid of him but now they have been warned by this investigator they know they have to offer him something else.

Yes and no. Should this all be sorted out it's something he needs to seriously consider, although I have a feeling it's just been offered hoping he will refuse, but showing they have offered an alternative.

So it might make sense for him to write down his understanding of the return to work meeting he had, and ask for clarification that he has understood it correctly; and ask if the continued suspension letter is an admin error.

 

And if the new job will make it easier for him to attend and I think you phrased it as "keep up", he should have a further discussion about it.

the complaint isnt upheld and whoever did the first investigtion is usually retrained.

Well he got the minutes. It was no surprise that these were rubbish too. I was surprised that whereas the first minutes mostly missed things out these ones actually were actually added to and complete fiction in some parts. What also confused me is the union rep (who signed my amended minutes at the first investigation which I asked to be put on the record) was called into the office the following day and reprimanded the following day for his shouting and aggressiveness during the interview. My husband was stunned , I think my husband would of prefered it if he actually was!

None, been trying to get hold of the area rep but keep getting fobbed off, yet he says it's been 'passed up the chain'. The union really havnt been any help at all. I've been telling him what limited info I know but the only benefit of the union has been that they can be witness to the meetings :(

Well, if the rep is accused of shouting, knows he didn't, and hubbie bears witness to that, I think the reliability of the person chairing the meeting should be called into account.

Would he do that in writing to them or is it something that he would need to say at a tribunal? I think it might be time to admit defeat tbh. I'm not sure how much more hubby can deal with. He's just constantly battling. His illness is progressing a a speedier rate than expected and I'm sure it's connected . The doctor has told both of us that stress and tension certainly won't be helping his condition and quite honestly I'd rather have a jobless husband than none :( the union have let him down big time and I'm trying to learn all I can but I think my brain is fried x thanks for all your advice xx

I don't think anyone can make that decision except your husband. I tend to agree with you, but I know other posters here wouldn't.

 

I would talk to the union again; and I would contest the minutes; and see where it gets you. These are simple things to do. An ET is a lot more stressful and needs more thought.

 

No win no fee lawyer re: the illness, maybe?

I'll def phone solicitor before anything and am told one of the union benefits is legal advice ( wish. The rep had told us this) and yes agreed it has to be his decision I just don't for a second want him to carry on thinking he's let us down in any way. There's no formal way to contest as its in house proceedure but presume the 3 days to ammend minutes is this? Sorry if that sounds thick . The 'notes' he received from the meeting don't actually mention the shouting by the rep but the boss had said when repremanding him that they got the notes from the meeting and he was aggressive, so this must be a different set of notes.

If the union may provide a solicitor, don't get your own - the union then won't fund one for you. So first call is the union to see :)

no problem - it's a horrible stressful time complicated by health worries. And the choices are between bad things, and worse things. Ask and talk as much as is helpful.

Never assume anyone on the internet is who they say they are. Only rely on advice from insured professionals you have paid for!

It's been a while but my husband has finally been charged ( even after offering him a deal saying they would drop everything if he returned to work, which now he feels well enough to has been taken off). I would really appreciate some advice regarding their evidence. Hes been charged with gross misconduct and should of attended a meeting today. I've did not receive the evid nice that was stated was included in his meeting letter so requested it and it has been rearranged for Monday. There is one email that they have given him. The incident happened over 6 months ago but The email is very though and worded in a way that would 'cover their back' in the event ova tribunal. It is written as if written on the day of the incident which I don't believe it was. Every other email I have copies of are dated and this seems to be the only one which isn't . Is there any way I can request the evidence to be supplied with a date, which presumably they have if in fact it was sent 6 months ago?

HSBC - 11/9/06 - prem letter sent

19/9/06 - lba sent £3391 requested

5/10/06 - MCOL

17/10/06 - offer for £1600 on one account recieved

28/11/06 - Full offer recieved

 

Capital one - 13/9/06 -letter asking for statements sent

17/10/06 - prelim sent for £640
