So as above for the mobile debts.....the statute of limitation started from your first missed contractual payment.

 

As regards the cat debt..there is no requirement for a creditor to retain a copy of the Default Notice..however should they litigate they will be expected to prove that one was served...normally they try to do this from software that proves one was sent...some judges accept some dont ...so luck of the draw.

So the default date on those 2 communications doesn't matter ?

Is this based on the bar of the phone line after failed first payment. 

 

When does the 6 years start on the cat debt.

No payment was ever made according to their paperwork.

Last order was in may 2014.

Given that you never made a payment towards the disputed cat debt ...from the date on the alleged DN missed payment plus 14 days

4 previous threads merged asking basically the same questions.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

To be fair Dx the time has passed my questions today are regarding the statue of limitations.

Not the same as before. Im just here for some advice.

Why so hostile ?

I'm just trying to beat these debts and sorry if it offends you.

I have just read the last few posts so forgive me if I have it wrong

 

When Lowell took me to court they could not provide any evidence a S87 DN was sent and tried to get away with a proforma DN with gaps for my name , amount etc. The SAR from the creditor also showed while a notice of default was sent, no details of a DN so the judge was having nothing to do with it. 

 

With regards to your mobile phone contract, I haven't read back who it was with but some split the contract so you have a regulated agreement to buy the handset and the non regulated agreement for airtime. Apart from that sorry I can't help you more
