i recived a letter from welcome saying they sold my debt to mkdp,

 

but welcome have not contacted me since 2007 and i have moved house twice since then

 

is this debt sb as i never made a payment as the car was not fit for purpose

 

any advice please i know they record defaulf six months after so called last payment so that would of been early 2008

So you took a loan from Welcome for a car?

 

This would have been around 2007?

 

You never made a payment against the loan?

 

I assume they have not got a CCJ by the back door? Have you checked your credit file to see if this appears on there in any form?

 

If they haven't got a CCJ already, there has been no payment since 2007 and no written acknowledgement by you in that time then this will be Statute Barred.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

i called them today to say my debt is statue barred

 

the women on the phone said i made a payment in 2008 which is rubbish

as i never started to pay for the car as the aa man told me to send it back asap in 2007

 

so i never made payment on account

 

what do we know about ghost payments on welcome accounts

 

i am told they just say transfair and no payment details

If they cannot provide proof of payment (i.e a copy of the transaction details, card number, cheque number etc) they are just clutching at straws.

 

You need to send them a CCA and SAR request.

 

In the letter tell them you do not acknowledge making a payment on the dates they have stated and that you believe the debt to be statue barred.

 

The last two times I've had people chase me over Statue Barred debts this is the only letter I've needed to send them.

Hello there,

 

MKRR would need to provide clear evidence that the 'payment' was made by you (or an 'agent' acting on your behalf). They would need to be able to show how the payment was made and where. Unless they can provide proof they will not be able to rely on the 'payment'. As Chuffter mentions you should dispute the payment and ask for proof. A CCA request and a SAR could be useful too.

i'd get an sar off to welcome

 

and get all the statements

 

with this and your other loan

 

you never know what charges & PPI they sold you.
