Advice needed please:

On Friday 25.04.2014 I went to Downham Leisure Centre to use the gym facilities there. I arrived around 19:20 pm.

 

 

This community based Leisure Centre is also " home" to a GP Practice with the operating hours of 08:00am to 18:30 pm Mon, Tue, Wed and Fri. On Thursday the practice is open 08:00am-20:00pm.

 

 

The Leisure Centre car park is run by a private company. There are about 5 to 6 allocated parking spaces for Doctors only.

 

 

Now bare in mind it was Friday evening, the GP practice was closed. When I arrived at the gym there was one parking spot in the allocated parking space as mentioned above. As my common practice for all the years I have been attending that gym ( about 5 years) I would parked in one of these spots once the GP Practice is closed on weekends or bank holidays. This I have been doing for years.

 

 

I was very surprised when I left the gym and found a parking ticket on my car for parking in the doctors allocated parking spots.

 

 

My argument against what I term as an unfair issue of this PCN is as follows.

1.the GP surgery was closed

2.the GP surgery does not provide a call out, on call or emergency after hours service, therefore Doctors do not come in to see patients after closing.

3.It is a community based facility and I see no reason why when the GP Practice is closed that parking spaces allocated to Doctors cannot be used by the users of the facility.

4.The parking spaces are there and not in use after the GP practice has closed.

 

 

Do I have reasonable grounds to fight this PCN based on the grounds listed above. I believe there are no valid or justified reasons as to why the parking spaces cannot be used when the GP Practice closed.

 

 

Please can I get your response or advice with regards to this matter. I have already sent my appeal online to the organisation who issued this PCN.

They will reject your appeal anyway but they will have to give a POPLA code.

 

This is a second "independant" appeal process.

When you get a response from them come back and by then your defense will have been formed

Is it a free car park?

 

The markings on the floor mean nothing in a private car park. Which private parking company run the car park?

 

Wait for the Notice To Keeper to arrive (around 28 days after the windscreen sticker). When you appeal to this, ask for a POPLA code to allow you to appeal further should they dismiss your appeal.

You have admitted being the driver by not waiting for the Notice To Keeper.

You have used ' mitigating' circumstances in your appeal.

Both the wrong thing to do...

 

When you get a response, post it up redacted, and we will give you the correct way to deal with it.

 

As above, who is the PPC?

at least you should get a speedy resposne to your appeal. What you put in the appeal to the parking bandits is of no real substance, what you put into your appeal to POPLA is important and doesnt have to have anything to do with the former so all you do now is wait for teh rejection letter and them make sure that letter has a POPLA code. No code and that is grounds for a complaint in itself.

Come back here when you get the next letter and we will tell you what to do.

Many thanks for the info u supplied will make an entry on this site once I hear from them... I sent the appeal on Friday 25th April .. No reply yet.

 

 

They will reject your appeal anyway but they will have to give a POPLA code.

When you get a response from them come back and by then your defense will have been formed

It is a free car park.. You are allowed to park for 150mins however after this you will get a ticket.

 

The company :Met Parking Services the car park is at the downham health and leisure centre

 

Is it a free car park?

In the mean time

Can you get some photos of the car park signs ?

They should be no smaller than 450mm X 450mm. So measure them

There must be a sign at the entrance to the car park.

Post up the photos on your thread so we can have a look.

Dear All,

on 25.04.14 I posted an entry regarding Met Parking Services who operates the car park at the Downham Health and Leisure Centre.

 

I had parked in the GP parking spot after 7pm on the night, and received a PCN for parking there.

I submitted an online appeal on 25.04.2014, which, to this day they haven't responded to.

 

My arguments were.

the GP practice closes at 18:30hrs

there is no on-call, emergency or callout services offered at the GP practice.

the leisure centre is a public facility for the people of the surrounding communities and the parking spaces for the GP after closing hours should be available for use by the public using the facility.

 

I also asked them to notify me of one justifiable valid reason why I cannot park in the t gp's spot when the practice is closed and the doctors have left the facility.

 

However I just (8.5.14 @ 10:30am) logged on to their website entered the PCN number and saw: Amount due £0

 

This is the second time I have challenged the "people" who operate this car park and won.

about 4 years ago G4 was managing that same car park and give me a ticket for allegedly parking there for 5 hours. I got my facts together and went after them with vigour and vitality. G4 in the end cancelled that PCN.

 

Challenge them, we work to hard for our money.

Had you seen a figure in the amount due box before today?

 

Don't recall, but to test the £0 charges i saw , today I attempted to pay make a payment with the PCN ref number: got a reply stating there is no outstanding monies owed for this reference number.

You shouldn't appeal anything until the notice to keeper comes through the post. And even then, don't do it online, do it via post.

 

Did it last week , did it a few years ago on line the same way, I was the driver not the owner... Result : successful .. Again. it worked for me.

Btw , the notice is addressed to the keeper , the driver , the registered owner.

they have 35 days to consider your appeal, after that time it is game over for them.

The argumant you should have used is that the parking spots tht are for the GP's is not part of the land they manage.

 

The arguments I used for this particular penalty charge notice ... Worked in my favour .
