    • Hi,  Update: the breeder has now had a solicitors letter sent to me refusing to accept judgement based on a faulty service ( claiming the name was spelt wrong etc), so no PoC has been received so I must stop the judgement or pay her costs in court as she now seeks an urgent order based on incorrect service.   I explained she confirmed their details twice upon being asked where she wanted docs to go and that she refused delivery at her home address of the action coming so she’s obstructed service herself.   lesley

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Now that MS have discontinued support for WinXP and in particular MSE what free antivirus do people recommend that will not hog up to many resources.

 

Please no recommendations of a new PC or different OS. The PC belongs to my mother so needs to be reasonably simple to use

Any opinion I give is from personal experience .

Thanks. I have used AVG in the past until MSE was available. I will have a look next time I am up there and stick one on.

 

TBH she really does need a new one but £2K on a cruise is ok but she can't afford a PC :roll:

have been using avira free on an xp (and win7) desktop. light on resources, seems effective, but has a couple of 'nag' screens though (which can be easily disabled if desired).

used to use avast, which was (and prob still is) v good, but it started to become a bit bloated (like avg) on resources.

imo.

avira or avast should do the trick , shame you can't put Kubuntu or Lubuntu on, and make it look like XP with a theme. Only joking.....

Thanks again. Blaming my mother for not wanting to change the OS is a good ploy don'y you think:oops:

No she should be ok with XP and one of those AVs, maybre Malwarbytes scan weekly as well to catch anything else the Av misses. Linux is always there as a free as in cash but with a learning cost when XPO is too risky,

and remember that if using int explorer browser on xp there won't be any security patches for it, such as for eg re this recent IE browser flaw (involving flash) http://www.maximumpc.com/microsoft_warns_zero-day_bug_internet_explorer

 

 

have noticed though that there are some patches available for manual download and installation from MS (i.e not the autoupdates site) for some versions of IE on xp sp3 re this exploit. if keeping IE!

 

have briefly tried icedragon and avant. former is just like fox, but with a couple of tweaks to the options and comodo settings. avant seems ok, no 'phoning home', but wld need getting used to re lots of 'options'. it also went awol when using fox mode. looks like will stick with fox for now for ease of use. :)
